1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 12-4.13b and adding Section 12-4.13c as
6follows:
 
7    (305 ILCS 5/12-4.13b)
8    Sec. 12-4.13b. College student eligibility for
9supplemental nutrition assistance benefits.
10    (a) For the purposes of Section 273.5(b)(11)(ii) of Title 7
11of the Code of Federal Regulations, a career and technical an
12educational program offered at a community college and approved
13by the Illinois Community College Board under the Carl D.
14Perkins Career and Technical Education Improvement Act of 2006
15(Public Law 109-270) that could be a component of a SNAP
16Employment and Training (E&T) program, as identified by the
17Department of Human Services, shall be considered an employment
18and training program under Section 273.7 of Title 7 of the Code
19of Federal Regulations, unless prohibited by federal law.
20    (b) The Department of Human Services, in consultation with
21representatives of the Illinois Community College Board, the
22Illinois Student Assistance Commission ISAC, the Illinois
23Workforce Innovation Board Investment Board, and advocates for

1students and SNAP recipients, shall establish a protocol to
2identify and verify all potential exemptions to the eligibility
3rule described in Section 273.5(a) of Title 7 of the Code of
4Federal Regulations, and to identify and verify a student's
5participation in educational programs, including, but not
6limited to, self-initiated placements, that would exempt a
7student from the eligibility rule described in Section 273.5(a)
8of Title 7 of the Code of Federal Regulations. To the extent
9possible, this consultation shall take place through existing
10workgroups convened by the Department of Human Services.
11    (c) If the United States Department of Agriculture requires
12federal approval of the exemption designation established
13pursuant to subsection (a) and the protocol established
14pursuant to subsection (b), the Department of Human Services
15shall seek and obtain that approval before publishing the
16guidance or regulation required by subsection (e).
17    (d)(1) This Section does not require the Department of
18Human Services to offer a particular component, support
19services, or workers' compensation to a college student found
20eligible for an exemption pursuant to this Section.
21    (2) This Section does not restrict or require the use of
22federal funds for the financing of SNAP E&T programs.
23    (3) This Section does not require an institution of higher
24education to verify eligibility for SNAP.
25    (e) The Department of Human Services shall adopt any rules
26necessary to implement the provisions of subsections (a), (b),

4    Sec. 12-4.13c. SNAP eligibility notification; college
5students.
6    (a) To complement student financial assistance programs
7and to enhance their effectiveness for students with financial
8need, the Illinois Student Assistance Commission (ISAC) shall
9annually include information about the Supplemental Nutrition
10Assistance Program (SNAP) in the language that schools are
11required to provide to students eligible for the Monetary Award
12Program grant. The language shall, at a minimum, direct
13students to information about college student eligibility
14criteria for SNAP, and it shall direct students to the
15Department of Human Services and to the Illinois Hunger
16Coalition's Hunger Hotline for additional information.
17    (b) Illinois institutions of higher education that
18participate in the Monetary Award Program (MAP) shall provide
19the notice described in subsection (a) to all students who are
20enrolled, or who are accepted for enrollment and intending to
21enroll, and who have been identified by ISAC as MAP-eligible at
22the institution. If possible, the institution may designate a
23public benefits liaison or single point person to assist
24students in taking the necessary steps to obtain public
25benefits if eligible.

1    (c) ISAC shall adopt any rules necessary to implement the
2provisions of this Section on or before October 1, 2020.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.
