AMENDMENT TO SENATE BILL 1449

2    AMENDMENT NO. ______. Amend Senate Bill 1449 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5adding Section 370c.2 as follows:
 
6    (215 ILCS 5/370c.2 new)
7    Sec. 370c.2. Task force on disability income insurance;
8parity for behavioral health conditions.
9    (a) As used in this Section, "behavioral health condition"
10means any mental, emotional, nervous, or substance use disorder
11or condition that falls under any of the diagnostic categories
12listed in the mental and behavioral disorders chapter of the
13current edition of the International Classification of Disease
14or that is listed in the most recent version of the Diagnostic
15and Statistical Manual of Mental Disorders.
16    (b) The Department shall form a task force to review the

1plans and policies for individual and group short-term and
2long-term disability income insurance issued and offered to
3individuals and employers in this State to examine the use of
4such insurance for behavioral health conditions. The task force
5shall be comprised of experts in the disability income
6insurance industry, experts in the behavioral health
7conditions and treatment industry, members of the general
8public, and 4 members of the General Assembly, 2 who shall be
9appointed by the President of the Senate and 2 who shall be
10appointed by the Speaker of the House of Representatives, with
11equal representation from the majority and minority parties.
12    (c) Appointments shall be made 90 days after the effective
13date of this amendatory Act of the 101st General Assembly.
14    (d) Members shall serve without compensation and shall be
15adults and residents of Illinois.
16    (e) The task force shall:
17        (1) review existing plans and policies for individual
18    and group short-term and long-term disability income
19    insurance issued, delivered, and offered in the State;
20        (2) compare consumer use of short-term and long-term
21    disability income insurance coverage for behavioral health
22    conditions with use of such insurance for physical
23    conditions;
24        (3) review reports of current costs incurred from
25    individual and group short-term and long-term disability
26    income insurance to cover behavioral health conditions at

1    parity with physical conditions; and
2        (4) provide recommendations on the use of individual
3    and group short-term and long-term disability income
4    insurance to cover behavioral health conditions.
5    (f) Any of the findings, recommendations, and other
6information determined by the task force to be relevant shall
7be made available on the Department's website.
8    (g) The task force shall submit findings and
9recommendations to the Governor and the General Assembly by
10December 31, 2020.
11    (h) The task force is dissolved and this Section is
12repealed on December 31, 2021.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
