AMENDMENT TO SENATE BILL 1423

2    AMENDMENT NO. ______. Amend Senate Bill 1423 as follows:
 
3on page 1, line 5, by replacing "14-110" with "7-139.8,
414-110,"; and
 
5on page 1, line 5, after "14-152.1" by inserting "and by adding
6Section 4-108.9"; and
 
7on page 1, immediately below line 5, by inserting the
8following:
 
9    "(40 ILCS 5/4-108.7 new)
10    Sec. 4-108.7. Transfer of creditable service to the State
11Employees' Retirement System.
12    (a) Any active member of the State Employees' Retirement
13System who is an arson investigator may apply for transfer of
14some or all of his or her credits and creditable service

1accumulated in any firefighters' pension fund under this
2Article to the State Employees' Retirement System in accordance
3with Section 14-110. The creditable service shall be
4transferred only upon payment by the firefighters' pension fund
5to the State Employees' Retirement System of an amount equal
6to:
7        (1) the amounts accumulated to the credit of the
8    applicant for the service to be transferred on file with
9    the fund on the date of transfer;
10        (2) employer contributions in an amount equal to the
11    amount determined under paragraph (1); and
12        (3) any interest paid by the applicant in order to
13    reinstate service to be transferred.
14    Participation in the firefighters' pension fund with
15respect to the service to be transferred shall terminate on the
16date of transfer.
17    (b) Any person applying to transfer service under this
18Section may reinstate service that was terminated by receipt of
19a refund, by paying to the firefighters' pension fund the
20amount of the refund with interest thereon at the actuarially
21assumed rate of interest, compounded annually, from the date of
22refund to the date of payment.

25    (a) Any active member of the State Employees' Retirement

1System who is a State policeman, an investigator for the
2Secretary of State, a conservation police officer, an
3investigator for the Office of the Attorney General, an
4investigator for the Department of Revenue, a Commerce
5Commission police officer, an investigator for the Office of
6the State's Attorneys Appellate Prosecutor, or a controlled
7substance inspector may apply for transfer of some or all of
8his or her credits and creditable service accumulated in this
9Fund for service as a sheriff's law enforcement employee,
10person employed by a participating municipality to perform
11police duties, or law enforcement officer employed on a
12full-time basis by a forest preserve district to the State
13Employees' Retirement System in accordance with Section
1414-110. The creditable service shall be transferred only upon
15payment by this Fund to the State Employees' Retirement System
16of an amount equal to:
17        (1) the amounts accumulated to the credit of the
18    applicant for the service to be transferred, including
19    interest; and
20        (2) municipality credits based on such service,
21    including interest; and
22        (3) any interest paid by the applicant to reinstate
23    such service.
24Participation in this Fund as to any credits transferred under
25this Section shall terminate on the date of transfer.
26    (b) Any person applying to transfer service under this

1Section may reinstate credits and creditable service
2terminated upon receipt of a separation benefit, by paying to
3the Fund the amount of the separation benefit plus interest
4thereon at the actuarially assumed rate of interest to the date
5of payment.

15on page 26, immediately below line 4, by inserting the
16following:
 
17    "Section 90. The State Mandates Act is amended by adding
18Section 8.43 as follows:

1    Sec. 8.43. Exempt mandate. Notwithstanding Sections 6 and 8
2of this Act, no reimbursement by the State is required for the
3implementation of any mandate created by this amendatory Act of
4the 101st General Assembly.".
