SYNOPSIS AS INTRODUCED:

    Amends the School Code. Defines "temporary door locking device". Provides that, upon submitting an application to the regional superintendent of schools, a school district may obtain a temporary door locking device for use on a school building. Specifies application requirements. Provides that an approved temporary door locking device shall be used only (i) by a staff member of a school district trained under the provision, (ii) during an emergency situation that threatens the health and safety of students and staff members or during an active shooter drill, and (iii) when law enforcement officials and the local fire department have been notified prior to use of the device. Provides that the device shall be engaged for a finite period of time in accordance with the school district's school safety plan adopted under the School Safety Drill Act. Provides that a school district with an approved temporary door locking device shall conduct an in-service training program for staff members on the proper use of the device.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-20.69 and 34-18.61 as follows:
 
6    (105 ILCS 5/10-20.69 new)
7    Sec. 10-20.69. Temporary door locking device.
8    (a) In this Section, "temporary door locking device" means
9an assembly of parts intended for use by a trained school staff
10member in a school building for the purpose of preventing both
11ingress and egress through a door of the building.
12    (b) Upon submitting an application to the regional
13superintendent of schools in a form and manner prescribed by
14the regional superintendent, a school district may obtain a
15temporary door locking device for use on a school building. The
16application shall include, but is not limited to:
17        (1) evidence of a properly adopted and filed school
18    safety plan under the School Safety Drill Act;
19        (2) a statement confirming that local law enforcement
20    officials, the local fire department, and the local
21    emergency management system have been notified about the
22    temporary door locking device, its location, and how to
23    disengage it;

1        (3) a description of the temporary door locking device
2    the school district proposes to acquire; and
3        (4) a statement confirming that any bolts, stops,
4    brackets, or pins employed by the temporary door locking
5    device do not affect the fire rating of a fire door
6    assembly.
7    Upon receiving an application under this subsection, a
8regional superintendent shall evaluate the school district's
9proposed temporary door locking device to ensure compliance
10with subsection (c). The regional superintendent may consult a
11local fire department when reviewing the application if the
12consultation would not result in an undue delay in approving or
13disapproving the application.
14    If a regional superintendent approves an application under
15this subsection, the approval shall be noted on the school
16building's certificate of occupancy. If a regional
17superintendent disapproves an application, he or she shall
18notify the school district of the decision and the reasons for
19the decision.
20    (c) An approved temporary door locking device shall be used
21only (i) by a staff member of a school district trained under
22subsection (d), (ii) during an emergency situation that
23threatens the health and safety of students and staff members
24or during an active shooter drill, and (iii) when law
25enforcement officials and the local fire department have been
26notified prior to use of the device. The device shall be

1engaged for a finite period of time in accordance with the
2school district's school safety plan adopted under the School
3Safety Drill Act. The device may not be permanently mounted to
4a door; however, assembly items such as bolts, stops, brackets,
5or pins that do not prevent ingress and egress through the door
6may be permanently mounted if they do not affect the fire
7rating of a fire door assembly. After it is engaged, the
8removal of the device must not require more than one operation;
9however, 2 operations may be permitted when the school building
10is equipped with an automatic sprinkler system.
11    (d) A school district with an approved temporary door
12locking device shall conduct an in-service training program for
13staff members on the proper use of the device. The school
14district shall keep a file verifying the staff members who have
15completed the program and shall provide the file to the local
16fire department upon request.

18    Sec. 34-18.61. Temporary door locking device.
19    (a) In this Section, "temporary door locking device" means
20an assembly of parts intended for use by a trained school staff

23    (b) Upon submitting an application to the State Board of
24Education in a form and manner prescribed by the State Board,
25the school district may obtain a temporary door locking device

1for use on a school building. The application shall include,
2but is not limited to:
3        (1) evidence of a properly adopted and filed school
4    safety plan under the School Safety Drill Act;

17State Board shall evaluate the school district's proposed
18temporary door locking device to ensure compliance with
19subsection (c). The State Board may consult the local fire
20department when reviewing the application if the consultation
21would not result in an undue delay in approving or disapproving
22the application.
23    If the State Board approves an application under this
24subsection, the approval shall be noted on the school
25building's certificate of occupancy. If the State Board
26disapproves an application, he or she shall notify the school

1district of the decision and the reasons for the decision.
