AMENDMENT TO SENATE BILL 1267

2    AMENDMENT NO. ______. Amend Senate Bill 1267 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Election Code is amended by changing
5Section 1-6 as follows:
 
6    (10 ILCS 5/1-6)
7    Sec. 1-6. Computing dates of various acts; Saturday,
8Sunday, and holidays.
9    (a) If the first or last day fixed by law to do any act
10required or allowed by this Code falls on a State holiday or a
11Saturday or a Sunday, the period shall extend through the first
12business day next following the day otherwise fixed as the
13first or last day, irrespective of whether any election
14authority or local election official conducts business on the
15State holiday, Saturday, or Sunday.
16    (b) For the purposes of this Section, "State holiday" means

1New Year's Day, Dr. Martin Luther King, Jr.'s Birthday,
2Lincoln's Birthday, President's Day, Casimir Pulaski's
3Birthday, Good Friday, Memorial Day, Independence Day, Labor
4Day, Columbus Day, Veterans' Day, Thanksgiving Day, Christmas
5Day, General Election Day, General Primary Election Day,
6Consolidated Election Day, Consolidated Primary Election Day,
7and any other day from time to time declared by the President
8of the United States or the Governor of Illinois to be a day
9during which the agencies of the State of Illinois that are
10ordinarily open to do business with the public shall be closed
11for business.
12    (c) Notwithstanding any other provision of this Code,
13nominating papers, petitions of objection to nominating
14papers, certificates of withdrawal of candidacy, and reports of
15political committees actually received by election authorities
16and local election officials on a State holiday, a Saturday, or
17a Sunday shall not be deemed invalid or defective for that
18reason alone.

20    Section 10. The Illinois Procurement Code is amended by
21changing Section 15-45 as follows:
 
22    (30 ILCS 500/15-45)
23    Sec. 15-45. Computation of days. The time within which any
24act provided in this Code is to be done shall be computed by

1excluding the first day and including the last, unless the last
2day is Saturday or Sunday or is a holiday, and then it shall
3also be excluded. If the day succeeding a Saturday, Sunday, or
4holiday is also a holiday, a Saturday, or a Sunday, then that
5succeeding day shall also be excluded. For the purposes of this
6Code, "holiday" means: New Year's Day; Dr. Martin Luther King,
7Jr.'s Birthday; Lincoln's Birthday; President's Day; Memorial
8Day; Independence Day; Labor Day; Columbus Day; Veterans' Day;
9Thanksgiving Day; Christmas Day; General Election Day; General
10Primary Election Day; Consolidated Election Day; Consolidated
11Primary Election Day; and any other day from time to time
12declared by the President of the United States or the Governor
13of Illinois to be a day during which the agencies of the State
14of Illinois that are ordinarily open to do business with the
15public shall be closed for business.

17    Section 15. The School Code is amended by changing Section
1824-2 as follows:

20    Sec. 24-2. Holidays.
21    (a) Teachers shall not be required to teach on Saturdays,
22nor, except as provided in subsection (b) of this Section,
23shall teachers or other school employees, other than
24noncertificated school employees whose presence is necessary

1because of an emergency or for the continued operation and
2maintenance of school facilities or property, be required to
3work on legal school holidays, which are January 1, New Year's
4Day; the third Monday in January, the Birthday of Dr. Martin
5Luther King, Jr.; February 12, the Birthday of President
6Abraham Lincoln; the first Monday in March (to be known as
7Casimir Pulaski's birthday); Good Friday; the day designated as
8Memorial Day by federal law; July 4, Independence Day; the
9first Monday in September, Labor Day; the second Monday in
10October, Columbus Day; November 11, Veterans' Day; the Thursday
11in November commonly called Thanksgiving Day; and December 25,
12Christmas Day; in even-numbered years, the first Tuesday after
13the first Monday in November, General Election Day; in
14even-numbered years, the third Tuesday in March, General
15Primary Election Day; in odd-numbered years, the first Tuesday
16in April, except as provided in Section 2A-1.1a of the Election
17Code, Consolidated Election Day; and in odd-numbered years, the
18last Tuesday in February, Consolidated Primary Election Day.
19School boards may grant special holidays whenever in their
20judgment such action is advisable. No deduction shall be made
21from the time or compensation of a school employee on account
22of any legal or special holiday.
23    (b) A school board or other entity eligible to apply for
24waivers and modifications under Section 2-3.25g of this Code is
25authorized to hold school or schedule teachers' institutes,
26parent-teacher conferences, or staff development on the third

1Monday in January (the Birthday of Dr. Martin Luther King,
2Jr.); February 12 (the Birthday of President Abraham Lincoln);
3the first Monday in March (known as Casimir Pulaski's
4birthday); the second Monday in October (Columbus Day); and
5November 11 (Veterans' Day), provided that:
6        (1) the person or persons honored by the holiday are
7    recognized through instructional activities conducted on
8    that day or, if the day is not used for student attendance,
9    on the first school day preceding or following that day;
10    and
11        (2) the entity that chooses to exercise this authority
12    first holds a public hearing about the proposal. The entity
13    shall provide notice preceding the public hearing to both
14    educators and parents. The notice shall set forth the time,
15    date, and place of the hearing, describe the proposal, and
16    indicate that the entity will take testimony from educators
17    and parents about the proposal.
18    (c) Commemorative holidays, which recognize specified
19patriotic, civic, cultural or historical persons, activities,
20or events, are regular school days. Commemorative holidays are:
21January 28 (to be known as Christa McAuliffe Day and observed
22as a commemoration of space exploration), February 15 (the
23birthday of Susan B. Anthony), March 29 (Viet Nam War Veterans'
24Day), September 11 (September 11th Day of Remembrance), the
25school day immediately preceding Veterans' Day (Korean War
26Veterans' Day), October 1 (Recycling Day), October 7 (Iraq and

1Afghanistan Veterans Remembrance Day), December 7 (Pearl
2Harbor Veterans' Day), and any day so appointed by the
3President or Governor. School boards may establish
4commemorative holidays whenever in their judgment such action
5is advisable. School boards shall include instruction relative
6to commemorated persons, activities, or events on the
7commemorative holiday or at any other time during the school
8year and at any point in the curriculum when such instruction
9may be deemed appropriate. The State Board of Education shall
10prepare and make available to school boards instructional
11materials relative to commemorated persons, activities, or
12events which may be used by school boards in conjunction with
13any instruction provided pursuant to this paragraph.
14    (d) City of Chicago School District 299 shall observe March
154 of each year as a commemorative holiday. This holiday shall
16be known as Mayors' Day which shall be a day to commemorate and
17be reminded of the past Chief Executive Officers of the City of
18Chicago, and in particular the late Mayor Richard J. Daley and
19the late Mayor Harold Washington. If March 4 falls on a
20Saturday or Sunday, Mayors' Day shall be observed on the
21following Monday.

23    Section 20. The State Universities Civil Service Act is
24amended by changing Section 45a as follows:

1    (110 ILCS 70/45a)  (from Ch. 24 1/2, par. 38l.1)
2    Sec. 45a. Except as provided in the second sentence of this
3Section, all officers and employees subject to this Act, shall
4have the following days as holidays, for which they shall
5receive their usual compensation: New Year's Day, January 1,
6Memorial Day, as determined by the law of the State of
7Illinois, Independence Day, July 4, Labor Day, the first Monday
8in September, Thanksgiving Day, the fourth Thursday of
9November, Christmas Day, December 25, in even-numbered years,
10the first Tuesday after the first Monday in November, General
11Election Day, in even-numbered years, the third Tuesday in
12March, General Primary Election Day, in odd-numbered years, the
13first Tuesday in April, except as provided in Section 2A-1.1a
14of the Election Code, Consolidated Election Day, in
15odd-numbered years, the last Tuesday in February, Consolidated
16Primary Election Day, and five holidays to be designated by
17each college, university, agency and community college subject
18to this Act. Craft and trade employees subject to this Act
19shall be paid for all paid holidays included in their area
20agreement, and will be paid for all five holidays designated by
21their employer pursuant to this section.

23    Section 99. Effective date. This Act takes effect upon
