1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-218 as follows:
 
7    (20 ILCS 2310/2310-218 new)
8    Sec. 2310-218. Phlebotomy on children and adults with
9intellectual and developmental disabilities.
10    (a) As used in this Section, "phlebotomist" means a person
11specifically trained to draw blood for diagnostic purposes in a
12health care setting.
13    (b) The Department shall make available training materials
14that ensure that all phlebotomists are trained in the most
15current methods of drawing blood from children and adults with
16intellectual and developmental disabilities. The materials
17shall conform to the best available practices used for drawing
18blood in a safe manner that is as comfortable as possible for
19the individual from whom blood is drawn and for the families,
20guardians, caretakers, or companions of the individual
21accompanying him or her while blood is drawn. The Department
22shall review these materials every 3 years to ensure that they
23conform with the best available practices.

1    (c) The Department shall ensure that health care providers,
2as that term is defined under the Health Care Services Lien
3Act, and laboratories, as that term is defined under the
4Illinois Clinical Laboratory and Blood Bank Act, that employ a
5phlebotomist incorporate the training described in subsection
6(b) as part of a phlebotomist's initial employment training and
7as part of any ongoing training to maintain competencies and
8certifications as a phlebotomist.
9    (d) This Section does not apply to nonprofit blood banks or
10the affiliated laboratories of nonprofit blood banks.
