AMENDMENT TO SENATE BILL 531

2    AMENDMENT NO. ______. Amend Senate Bill 531, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Toll Bridge Act is amended by changing
6Section 7 as follows:
 
7    (605 ILCS 115/7)  (from Ch. 137, par. 7)
8    Sec. 7. Toll rates; electronic toll collection.
9    (a) The county board shall fix the rates of toll, and may
10from time to time, alter and change the same, including by
11establishing a toll rate schedule, setting a maximum toll rate
12that may be adjusted from time to time, or by establishing
13another toll rate structure, and in case of the neglect of the
14owner of the bridge to keep the same in proper repair and safe
15for the crossing of persons and property, may prohibit the
16taking of toll.

1    (b) Notwithstanding any law to the contrary, the county
2board may enter into an agreement establishing a toll rate
3schedule for a period not to exceed 99 years. This amendatory
4Act of the 101st General Assembly is declarative of existing
5law and shall be given retroactive effect.
6    (c) Except as regarding toll bridges or as otherwise
7provided by law, nothing in Public Act 101-398 this amendatory
8Act of the 101st General Assembly shall be construed to
9authorize a county, municipality, local government, or private
10operator to impose a toll upon any public road, street, or
11highway; nor shall any provision of Public Act 101-398 this
12amendatory Act of the 101st General Assembly be construed to
13authorize, pursuant to an intergovernmental agreement or
14otherwise, the imposition of any toll upon any public road,
15street, or highway.
16    (d) The General Assembly finds that electronic toll
17collection systems in Illinois should be standardized to
18promote safety, efficiency, and traveler convenience. If
19electronic toll collection is used on such bridge, the county
20shall cause the configuration of the electronic toll collection
21system to be compatible with the electronic toll collection
22system used by the Illinois State Toll Highway Authority. The
23municipality or private operator may enter into an agreement
24with the Illinois State Toll Highway Authority to provide for
25such compatibility or to have the Authority provide electronic
26toll collection or toll violation enforcement services. Any

1toll bridges in Winnebago County that are in operation and
2collecting tolls on the effective date of this amendatory Act
3of the 97th General Assembly are exempt from the provisions of
4the Act.
