AMENDMENT TO SENATE BILL 55

2    AMENDMENT NO. ______. Amend Senate Bill 55 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Transportation Network Providers Act is
5amended by changing Section 15 as follows:
 
6    (625 ILCS 57/15)
7    (Section scheduled to be repealed on June 1, 2020)
8    Sec. 15. Driver requirements.
9    (a) Prior to permitting an individual to act as a TNC
10driver on its digital platform, the TNC shall:
11        (1) require the individual to submit an application to
12    the TNC or a third party on behalf of the TNC, which
13    includes information regarding his or her full legal name,
14    social security number, address, age, valid date of birth,
15    driver's license, driving history, motor vehicle
16    registration, automobile liability insurance,

1    fingerprints, and other information required by the TNC;
2        (2) require each individual to submit his or her
3    fingerprints to the Department of State Police in an
4    electronic format that complies with the form and manner
5    for requesting and furnishing criminal history record
6    information as prescribed by the Department of State Police
7    and provide the TNC with a copy of the permit issued under
8    subsection (d); and conduct, or have a third party conduct,
9    a local and national criminal history background check for
10    each individual applicant that shall include:
11            (A) Multi-State or Multi-Jurisdictional Criminal
12        Records Locator or other similar commercial nationwide
13        database with validation (primary source search); and
14            (B) National Sex Offenders Registry database; and
15        (3) search the Illinois and National Sex Offender
16    Registry database. obtain and review a driving history
17    research report for the individual.
18    (b) The TNC shall not permit an individual to act as a TNC
19driver on its digital platform who:
20        (1) has had more than 3 moving violations in the prior
21    three-year period, or one major violation in the prior
22    three-year period including, but not limited to,
23    attempting to evade the police, reckless driving, or
24    driving on a suspended or revoked license;
25        (2) is not of good moral character has been convicted,
26    within the past 7 years, of driving under the influence of

1    drugs or alcohol, fraud, sexual offenses, use of a motor
2    vehicle to commit a felony, a crime involving property
3    damage, or theft, acts of violence, or acts of terror;
4        (3) is a match in the Illinois or National Sex
5    Offenders Registry database;
6        (4) does not possess a valid driver's license;
7        (5) does not possess proof of registration for the
8    motor vehicle used to provide TNC services;
9        (6) does not possess proof of automobile liability
10    insurance for the motor vehicle used to provide TNC
11    services; or
12        (7) is under 19 years of age.
13    (c) (Blank). An individual who submits an application under
14paragraph (1) of subsection (a) that contains false or
15incomplete information shall be guilty of a petty offense.
16    (d) The fingerprints required by paragraph (2) of
17subsection (a) shall be transmitted through a live scan
18fingerprint vendor licensed by the Department of Financial and
19Professional Regulation. The fingerprints shall be checked
20against the Department of State Police and Federal Bureau of
21Investigation criminal history record databases now and
22hereafter filed. The Department of State Police shall charge
23applicants a fee for conducting the criminal history records
24check, which shall be deposited into the State Police Services
25Fund and shall not exceed the actual cost of the records check.
26The Department of State Police shall furnish, pursuant to

1positive identification, records of Illinois convictions to
2the Secretary of State. The Secretary of State shall obtain and
3review a driving history research report for the individual.
4The Secretary of State shall issue a permit to an applicant who
5has met all the requirements of the screening process under
6this Section to ensure the welfare and safety of citizens
7throughout the State of Illinois. The applicant, as part of the
8TNC application process, shall provide a copy of the permit.
9    (e) In determining good moral character for purposes of
10paragraph (2) of subsection (b), the TNC may take into
11consideration the individual's conviction of any crime under
12the laws of the United States or any state or territory thereof
13that is a classified as a felony or misdemeanor directly
14related to: driving under the influence of drugs or alcohol,
15fraud, sexual offenses, use of a motor vehicle to commit a
16felony, theft, acts of violence, or acts of terror.
