HOUSE RESOLUTION

 
2    WHEREAS, The U.S. Congress passed into law the National
3Childhood Vaccine Injury Act of 1986, which states that no
4"vaccine manufacturer shall be liable in a civil action for
5damages arising from a vaccine-related injury or death
6associated with the administration of a vaccine after October
71, 1988, if the injury or death resulted from side effects that
8were unavoidable even though the vaccine was properly prepared
9and was accompanied by proper directions and warnings"; and
 
10    WHEREAS, In 2011, the United States Supreme Court ruled in
11Bruesewitz v. Wyeth that the "National Childhood Vaccine Injury
12Act pre-empts all design-defect claims against vaccine
13manufacturers brought by plaintiffs who seek compensation for
14injury or death caused by vaccine side effects"; and
 
15    WHEREAS, Our individual human rights should outweigh the
16profits of pharmaceutical companies, and individuals should
17have the ability to hold vaccine manufacturers liable for
18design defects that result in adverse side effects from
19vaccines; and
 
20    WHEREAS, The European Union has found a way to allow
21evidence-based lawsuits to hold vaccine manufacturers liable
22without destabilizing the European health care system;

1therefore, be it
 
2    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
3HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
4we urge the Congress of the United States to pass, and the
5President to sign, legislation removing 42 U.S.C.
6300aa-22(b)(1) from law and allowing design defect claims
7against vaccine manufacturers by individuals who have
8experienced adverse side effects caused by vaccines; and be it
9further
 
10    RESOLVED, That suitable copies of this resolution be
11delivered to the President of the United States, the U.S.
12Senate Majority Leader, the U.S. Speaker of the House of
13Representatives, each member of the Illinois Congressional
14Delegation, and the U.S. Secretary of Health and Human
15Services.
