SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. Provides that expenditures shall not exceed proposed revenue (rather than funds) estimated to be available for a fiscal year. Provides that except for deficiency or emergency appropriations, all appropriations are expendable only during the fiscal year for which they were appropriated. Provides that no public money shall be expended except as provided by appropriations made by law. Provides that expenditures for any fiscal year shall not exceed the State's revenues and reserves, including proceeds of any debt obligation, for that year. Provides that no debt obligation, except as shall be repaid within the fiscal year of issuance, shall be authorized for the current operation of any State service or program, nor shall the proceeds of any debt obligation be expended for a purpose other than that for which it was authorized. Provides that any law requiring the expenditure of State funds shall be null and void unless, during the session in which the act receives final passage, an appropriation is made for the estimated first-year's funding. Defines "revenue". Effective upon being declared adopted.

3    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
4HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5SENATE CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Section 2 of Article
9VIII of the Illinois Constitution as follows:

13SECTION 2. STATE FINANCE
14    (a) The Governor shall prepare and submit to the General
15Assembly, at a time prescribed by law, a State budget for the
16ensuing fiscal year. The budget shall set forth the estimated
17balance of revenue funds available for appropriation at the
18beginning of the fiscal year, the estimated receipts, and a
19plan for expenditures and obligations during the fiscal year of
20every department, authority, public corporation and
21quasi-public corporation of the State, every State college and
22university, and every other public agency created by the State,
23but not of units of local government or school districts. The

1budget shall also set forth the indebtedness and contingent
2liabilities of the State and such other information as may be
3required by law. Proposed expenditures shall not exceed revenue
4funds estimated to be available for the fiscal year as shown in
5the budget. For the purposes of this Section, "revenue" means
6the receipts from taxes and fees, and does not include debt
7incurred, existing debt refinanced, or additional funds
8resulting from fund sweeps.
9    (b) The General Assembly by law shall make appropriations
10for all expenditures of public funds by the State.
11Appropriations for a fiscal year shall not exceed revenue funds
12estimated by the General Assembly to be available during that
13year. Except for deficiency or emergency appropriations, all
14appropriations are expendable only during the fiscal year for
15which they were appropriated.
16    (c) No public money shall be expended except as provided by
17appropriations made by law. Expenditures for any fiscal year
18shall not exceed the State's revenues and reserves, including
19proceeds of any debt obligation, for that year. No debt
20obligation, except as shall be repaid within the fiscal year of
21issuance, shall be authorized for the current operation of any

SCHEDULE
5    This Constitutional Amendment takes effect upon being
6declared adopted in accordance with Section 7 of the Illinois
7Constitutional Amendment Act.
