SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-6-12 new

    Amends the Illinois Municipal Code. Provides that the Chicago Fire Department Joint Labor Management Committee is created with the Fire Commissioner of the City of Chicago as a member along with 7 members appointed to the Committee by the Fire Commissioner. Provides that the Committee may establish minimum guidelines and standards for: (1) all personal protective equipment for the Chicago Fire Department; and (2) the qualifications possessed by members of the Chicago Fire Department who are temporarily appointed by the Fire Commissioner having direct supervisory authority over sworn firefighters, paramedics, or emergency medical technicians of the Chicago Fire Department, including employment diversity goals that reflect the diversity of the City of Chicago. Provides that the guidelines and standards approved by the Committee are binding on the Chicago Fire Department except to the extent the guidelines or standards conflict with a collective bargaining agreement. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-6-12 as follows:
 
6    (65 ILCS 5/11-6-12 new)
7    Sec. 11-6-12. Chicago Fire Department Joint Labor
8Management Committee.
9    (a) The Chicago Fire Department Joint Labor Management
10Committee is created in the Chicago Fire Department. The
11Committee shall consist of the Fire Commissioner of the City of
12Chicago or his or her designee and the following members
13appointed by the Fire Commissioner: 4 members who, at the time
14of appointment, are members of the executive board of an
15organization representing firefighters in the City of Chicago
16who were elected at-large to the executive board; and 3 members
17who, at the time of appointment, are sworn members of the
18Chicago Fire Department and who are not members of the
19executive board of an organization representing firefighters
20in the City of Chicago.
21    Members of the Committee shall be appointed for terms of
22one year beginning on June 1, 2020 and on June 1 of each year
23thereafter. Initial appointments shall be made no later than 60

1days after the effective date of this amendatory Act of the
2101st General Assembly. On July 1, 2020 and on July 1 of each
3year thereafter, the Committee shall meet and elect from among
4its members a chair and vice-chair who shall serve for terms of
5one year. The Committee shall hold such other meetings as
6needed to accomplish its purpose under this Section at the call
7of the chair.
8    If a member is unable or unwilling to serve, the Fire
9Commissioner shall, as soon as is practicable, appoint a
10replacement who shall serve until that member is able to serve
11again or until the next June 1, whichever occurs first.
12    (b) The Committee shall establish minimum guidelines and
13standards for:
14        (1) all personal protective equipment utilized by
15    members of the Chicago Fire Department; "personal
16    protective equipment" means any clothing or equipment
17    required by the City of Chicago or provided by the City of
18    Chicago that provides or enhances the safety of the members
19    of the Chicago Fire Department; and
20        (2) the qualifications possessed by members of the
21    Chicago Fire Department who are temporarily appointed by
22    the Fire Commissioner having direct supervisory authority
23    over sworn firefighters, paramedics, or emergency medical
24    technicians of the Chicago Fire Department, including
25    employment diversity goals that reflect the diversity of
26    the City of Chicago.

1    The Committee shall approve initial minimum guidelines and
2standards under this subsection no later than 180 days after
3the effective date of this amendatory Act of the 101st General
4Assembly, and shall amend those minimum guidelines and
5standards as needed. The approval and amendment of minimum
6guidelines and standards under this subsection shall require an
7affirmative vote of at least 5 members of the Committee.
8    (c) Except as otherwise provided in this subsection (c),
9minimum guidelines and standards approved under subsection (b)
10are binding on the Chicago Fire Department and the City of
11Chicago. However, if there is a conflict in whole or part
12between the minimum guidelines and standards established by the
13Committee and an express provision of a collective bargaining
14agreement between the City of Chicago and its exclusive
15bargaining agent representing sworn members of the Chicago Fire
16Department, the express provisions of the collective
17bargaining agreement shall control, notwithstanding the
18minimum guidelines and standards.
19    (d) The Committee may by a majority vote adopt such rules
20as it deems necessary to implement this Section.
21    (e) The Committee shall hold meetings, as necessary, at the
22headquarters of the Chicago Fire Department. The City of
23Chicago shall provide administrative and other support to the
24Committee.
25    (f) The City of Chicago may not regulate the Committee,
26including the Committee's establishment of minimum guidelines

1and standards under subsection (b), in a manner inconsistent
2with this Section. This Section is a limitation under
3subsection (i) of Section 6 of Article VII of the Illinois
4Constitution on the concurrent exercise by home rule units of
5powers and functions exercised by the State.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
