SYNOPSIS AS INTRODUCED:
 
325 ILCS 5/11.2b new

    Amends the Abused and Neglected Child Reporting Act. Provides that a parent or legal guardian employing an individual to care for his or her minor child may request from the individual the results of a check on the individual through the Child Abuse and Neglect Tracking System by submitting the same form and paying the same fee that would be submitted by an entity required by law to request such a background check on an employee or volunteer for the purpose of determining whether there has been an indicated finding of child abuse or neglect for the individual. Requires the form to contain the signature of the individual consenting to the background check. Requires the Department of Children and Family Services to notify the individual on whom the background check was completed of the results. Provides that the Department shall make the form for requesting a check of the Child Abuse and Neglect Tracking System available on its website along with information on how to locate a child-care provider certified or licensed by the Department and how to request a criminal background check for a child-care provider. Requires the Department to adopt rules to implement the provisions of the amendatory Act.

1    AN ACT concerning children.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Abused and Neglected Child Reporting Act is
5amended by adding Section 11.2b as follows:
 
6    (325 ILCS 5/11.2b new)
7    Sec. 11.2b. Child Abuse and Neglect Tracking System
8background check; parent initiated.
9    (a) A parent or legal guardian employing an individual to
10care for his or her minor child may request the results of a
11check on the individual through the Child Abuse and Neglect
12Tracking System by submitting the same form and paying the same
13fee that would be submitted by an entity required by law to
14request such a background check on an employee or volunteer for
15the purpose of determining whether there has been an indicated
16finding of child abuse or neglect for the individual. The form
17shall contain the signature of the individual consenting to the
18background check.
19    (b) The Department shall notify the individual on whom the
20background check was completed of the results.
21        (1) If the results show no indicated findings of child
22    abuse or neglect for the individual following a check of
23    the Child Abuse and Neglect Tracking System, the Department

1    shall send the individual a letter stating that the
2    individual has no indicated findings of abuse or neglect.
3        (2) If the results show indicated findings of child
4    abuse or neglect for the individual following a check of
5    the Child Abuse and Neglect Tracking System, the Department
6    shall send the individual the results of the background
7    check.
8    (c) The Department shall make the form for requesting a
9check of the Child Abuse and Neglect Tracking System available
10on its website along with information on how to locate a
11child-care provider certified or licensed by the Department and
12how to request a criminal background check for a child-care
13provider.
14    (d) The Department shall adopt any rules necessary to
15implement the provisions of this Section.
