A BILL FOR

HB5399LRB101 16721 RJF 66110 b

1    AN ACT concerning State government.

2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:

4    Section 1. Legislative Findings. The General hereby finds
5and declares that:
6        (1) The State of Illinois faces constantly evolving
7    threats to its information technology systems. These
8    treats can range from individuals to state or
9    state-sponsored actors including, China, Iran, North
10    Korea, and Russia. To counter this threat, the State of
11    Illinois needs to contract with outside vendors to obtain
12    the latest in cybersecurity software. In addition to being
13    effective, it is equally important that the software
14    obtained can be relied upon not to provide a hostile actor
15    access to the State's information technology systems.
16        (2) Kaspersky Lab is a Russian cybersecurity company
17    founded in 1997 by Eugene Kaspersky, and based in Moscow,
18    Russia. The company's founder, Eugene Kaspersky, also has a
19    history with Russian intelligence activities and was
20    educated at the Technical Faculty of the KGB Higher School.
21        (3) Under Russian law, their Federal Security Service,
22    the successor to the KGB, can compel a telecommunications
23    business to install software to assist in its operations
24    and can assign officers to work at a company.

HB5399- 2 -LRB101 16721 RJF 66110 b

1        (4) The federal Government has already prohibited
2    Kaspersky Lab's products from being used by the federal
3    Government in the 2018 National Defense Authorization Act.
4    When 6 heads of United States intelligence agencies were
5    asked during a United States Senate Committee on
6    Intelligence hearing if they would install Kaspersky
7    software on their own computers, all replied no.
8        (5) Because the federal government has determined that
9    the use of software obtained from Kaspersky Lab would be a
10    national security threat, use of Kaspersky Lab software
11    would also be a threat to the security of the State of
12    Illinois.

13    Section 5. The Illinois Information Security Improvement
14Act is amended by adding Section 5-30 as follows:

15    (20 ILCS 1375/5-30 new)
16    Sec. 5-30. Cybersecurity software prohibited. No State
17agency shall use any software platform developed, in whole or
18in part, by Kaspersky Lab or any entity of which Kaspersky Lab
19holds majority ownership. The Department shall adopt rules as
20necessary to implement this Section.
