SYNOPSIS AS INTRODUCED:
 
60 ILCS 1/235-25

    Amends the Township Code. Provides that tentative budgets for specified road districts shall be subject to a public hearing and public inspection prior to adopting. Further provides that the township board may adopt all or part of the tentative budget and appropriation ordinance for road purposes and levy the amount determined by the board (currently, the township board shall adopt all the tentative budget and appropriation ordinance and levy the amount determined by the highway commissioner). Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Township Code is amended by changing Section
5235-25 as follows:
 
6    (60 ILCS 1/235-25)
7    Sec. 235-25. Tentative budget and appropriation ordinance
8and tax for road purposes. In each road district comprised of
9a single township:
10    (a) The township board must hold a public hearing before
11adopting a budget and appropriation ordinance for road
12purposes.
13    (b) The township board must, at least 30 days before a
14public hearing, prepare or cause to be prepared a tentative
15budget and appropriation ordinance for road purposes and file
16the ordinance with the township clerk. The township clerk must
17make the tentative budget and appropriation ordinance for road
18purposes available for public inspection for at least 30 days
19before final action on the ordinance. The required public
20hearing must be held on or before the last day of the first
21quarter of the fiscal year before the township board. Notice of
22the hearing must be given by publication in a newspaper
23published in the township at least 30 days before the time of

1the hearing. If there is no newspaper published in the
2township, notice of the public hearing may be given by posting
3notices in 5 of the most public places in the township. It is
4the duty of the township clerk to arrange for the public
5hearing.
6    (c) The , the township board may shall adopt all or part of
7a tentative budget and appropriation ordinance for road
8purposes, as the township board deems necessary, and shall levy
9the amount determined by the board highway commissioner and
10certify to the county clerk the amount necessary to be raised
11by taxation for road purposes as provided in Section 6-501 of
12the Illinois Highway Code.

14    Section 99. Effective date. This Act takes effect upon
