    Amends the Nursing Home Care Act. Allows long-term care facilities to provide an opioid treatment program if they receive written approval from the Department of Public Health. Provides requirements for such an opioid treatment program.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Nursing Home Care Act is amended by adding
5Section 2-218 as follows:
 
6    (210 ILCS 45/2-218 new)
7    Sec. 2-218. Opioid treatment program.
8    (a) A long-term care facility that desires to provide an
9opioid treatment program must first receive written approval
10from the Department. The approval shall be granted only if it
11can be shown that the program will not interfere in any way
12with the residents in the other parts of the facility.
13    (b) The opioid treatment program must be in a completely
14separate and distinct part of the long-term care facility and
15must include all beds in that separate and distinct part. It
16must be completely separated from the rest of the facility and
17have separate entrances.
18    (c) Beds designated for opioid treatment shall not be used
19for long-term care residents, nor shall beds designated for
20long-term care residents be used for residents undergoing
21treatment for opioids.
22    (d) The opioid treatment program staff shall not be
23utilized in performing services in the long-term care area of

1the facility, nor shall long-term care program staff be
2utilized to provide any services in the opioid treatment
3designated area.
4    (e) There may be joint use of laundry, food service,
5housekeeping, and administrative services, provided written
6approval is obtained from the Department. The approval shall be
7granted only if it can be shown that the joint usage will not
8interfere in any way with the residents in other parts of the
9facility.
