SYNOPSIS AS INTRODUCED:
 
225 ILCS 410/3-7  from Ch. 111, par. 1703-7

    Amends the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. Provides that the continuing education requirement for cosmetologists does not apply to a licensee who is 70 years or older and has been licensed as a cosmetologist for at least 25 years.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Barber, Cosmetology, Esthetics, Hair
5Braiding, and Nail Technology Act of 1985 is amended by
6changing Section 3-7 as follows:
 
7    (225 ILCS 410/3-7)  (from Ch. 111, par. 1703-7)
8    (Section scheduled to be repealed on January 1, 2026)
9    Sec. 3-7. Licensure; renewal; continuing education. The
10holder of a license issued under this Article III may renew
11that license during the month preceding the expiration date
12thereof by paying the required fee, giving such evidence as the
13Department may prescribe of completing not less than 14 hours
14of continuing education for a cosmetologist, and 24 hours of
15continuing education for a cosmetology teacher or cosmetology
16clinic teacher, within the 2 years prior to renewal. The
17training shall be in subjects approved by the Department as
18prescribed by rule upon recommendation of the Board and may
19include online instruction.
20    For the initial renewal of a cosmetologist's license which
21requires continuing education, as prescribed by rule, one hour
22of the continuing education shall include domestic violence and
23sexual assault awareness education as prescribed by rule of the

1Department. For every subsequent renewal of a cosmetologist's
2license, one hour of the continuing education may include
3domestic violence and sexual assault awareness education as
4prescribed by rule of the Department. The one-hour domestic
5violence and sexual assault awareness continuing education
6course shall be provided by a continuing education provider
7approved by the Department, except that completion from March
812, 2016 to March 15, 2016 of a one-hour domestic violence and
9sexual assault awareness course from a domestic violence and
10sexual assault awareness organization shall satisfy this
11requirement.
12    The Department may prescribe rules regarding the
13requirements for domestic violence and sexual assault
14awareness continuing education courses and teachers.
15    The Department shall establish by rule a means for the
16verification of completion of the continuing education
17required by this Section. This verification may be accomplished
18through audits of records maintained by registrants, by
19requiring the filing of continuing education certificates with
20the Department, or by other means established by the
21Department.
22    The Department, in its discretion, may waive enforcement of
23the continuing education requirement in this Section,
24including the domestic violence and sexual assault awareness
25education requirement, and shall adopt rules defining the
26standards and criteria for that waiver under the following

1circumstances:
2        (a) the licensee resides in a locality where it is
3    demonstrated that the absence of opportunities for such
4    education would interfere with the ability of the licensee
5    to provide service to the public;
6        (b) that to comply with the continuing education
7    requirements would cause a substantial financial hardship
8    on the licensee;
9        (c) that the licensee is serving in the United States
10    Armed Forces; or
11        (d) that the licensee is incapacitated due to illness.
12    The continuing education requirements of this Section do
13not apply to a licensee who is 70 years of age or older and has
14been licensed as a cosmetologist for at least 25 years.
