SYNOPSIS AS INTRODUCED:
 
25 ILCS 120/7 new

    Amends the Compensation Review Act. Provides that members of the General Assembly may at any time elect not to receive any increase in compensation that would otherwise apply based on a cost of living adjustment for or during any given fiscal year. Provides that upon electing not to receive a cost of living adjustment, the amount by which a member's compensation would have increased but for the election not to receive such funds shall be paid into the State Pensions Fund. Provides that once a member of the General Assembly elects not to receive a cost of living adjustment, he or she shall not be eligible to receive a cost of living adjustment for the remainder of the fiscal year in which the election was made. Provides that any increase in compensation received as a cost of living adjustment by a member of the General Assembly prior to the election not to receive such funds shall be repaid to the State and deposited into the State Pensions Fund.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Compensation Review Act is amended by adding
5Section 7 as follows:
 
6    (25 ILCS 120/7 new)
7    Sec. 7. COLA opt-out. Notwithstanding any provision of law
8to the contrary, members of the General Assembly may at any
9time elect not to receive any increase in compensation that
10would otherwise apply based on a cost of living adjustment, as
11authorized by Senate Joint Resolution 192 of the 86th General
12Assembly, for or during any given fiscal year. Upon electing
13not to receive a cost of living adjustment under this Section,
14the amount by which a member's compensation would have
15increased but for the election not to receive such funds shall
16be paid into the State Pensions Fund. Once a member of the
17General Assembly elects not to receive a cost of living
18adjustment, he or she shall not be eligible to receive a cost
19of living adjustment for the remainder of the fiscal year in
20which the election was made. Any increase in compensation
21received as a cost of living adjustment by a member of the
22General Assembly prior to the election not to receive such
