SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12-20  from Ch. 38, par. 12-20

    Amends the Criminal Code of 2012. Provides that the penalty for knowingly buying or selling, or offering to buy or sell, a human body or any part of a human body is a Class 4 felony (rather than a Class A misdemeanor) for the first conviction and a Class 3 felony (rather than a Class 4 felony) for subsequent convictions.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 12-20 as follows:
 
6    (720 ILCS 5/12-20)  (from Ch. 38, par. 12-20)
7    Sec. 12-20. Sale of body parts.
8    (a) Except as provided in subsection (b), any person who
9knowingly buys or sells, or offers to buy or sell, a human body
10or any part of a human body, is guilty of a Class 4 felony A
11misdemeanor for the first conviction and a Class 3 4 felony for
12subsequent convictions.
13    (b) This Section does not prohibit:
14        (1) An anatomical gift made in accordance with the
15    Illinois Anatomical Gift Act.
16        (2) (Blank).
17        (3) Reimbursement of actual expenses incurred by a
18    living person in donating an organ, tissue or other body
19    part or fluid for transplantation, implantation, infusion,
20    injection, or other medical or scientific purpose,
21    including medical costs, loss of income, and travel
22    expenses.
23        (4) Payments provided under a plan of insurance or

1    other health care coverage.
2        (5) Reimbursement of reasonable costs associated with
3    the removal, storage or transportation of a human body or
4    part thereof donated for medical or scientific purposes.
5        (6) Purchase or sale of blood, plasma, blood products
6    or derivatives, other body fluids, or human hair.
7        (7) Purchase or sale of drugs, reagents or other
8    substances made from human bodies or body parts, for use in
9    medical or scientific research, treatment or diagnosis.
