AMENDMENT TO HOUSE BILL 3305

2    AMENDMENT NO. ______. Amend House Bill 3305 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
522-85 as follows:
 
6    (105 ILCS 5/22-85 new)
7    Sec. 22-85. Make Sexual Abuse Fully Extinct (Make S.A.F.E.)
8Task Force.
9    (a) The General Assembly finds that the most precious
10resource in this State is our children. The General Assembly
11also finds that the protection of children from sexual abuse
12and exploitation is at the core of the duties and fundamental
13responsibilities of the General Assembly and is of the utmost
14importance.
15    (b) The Make Sexual Abuse Fully Extinct (Make S.A.F.E.)
16Task Force is created to address issues concerning the sexual

1abuse of students in school-related settings. The Task Force
2shall consist of all of the following members, who must be
3appointed no later than 30 days after the effective date of
4this amendatory Act of the 101st General Assembly:
5        (1) One representative appointed by the Speaker of the
6    House of Representatives.
7        (2) One representative appointed by the Minority
8    Leader of the House of Representatives.
9        (3) One senator appointed by the President of the
10    Senate.
11        (4) One senator appointed by the Minority Leader of the
12    Senate.
13        (5) One member who represents the Children's Advocacy
14    Centers of Illinois appointed by the State Superintendent
15    of Education.
16        (6) The Executive Director of an urban, accredited
17    Children's Advocacy Center appointed by the State
18    Superintendent of Education.
19        (7) The Executive Director of a suburban, accredited
20    Children's Advocacy Center appointed by the State
21    Superintendent of Education.
22        (8) The Executive Director of a rural, accredited
23    Children's Advocacy Center appointed by the State
24    Superintendent of Education.
25        (9) One member of the State Board of Education
26    appointed by the State Superintendent of Education.

1        (10) One member representing a State's Attorney office
2    appointed by the State Superintendent of Education.
3        (11) One member representing a statewide organization
4    that unites the services and resources of rape crisis
5    centers, alleviates the suffering of sexual assault
6    survivors, and helps build communities appointed by the
7    State Superintendent of Education.
8        (12) One member representing the Department of State
9    Police appointed by the State Superintendent of Education.
10        (13) One member representing the Department of
11    Children and Family Services appointed by the State
12    Superintendent of Education.
13        (14) One member representing the Office of the Attorney
14    General appointed by the State Superintendent of
15    Education.
16        (15) One member representing a statewide organization
17    representing school management positions appointed by the
18    State Superintendent of Education.
19        (16) One member representing a statewide professional
20    teachers' organization appointed by the State
21    Superintendent of Education.
22        (17) One member representing a different statewide
23    professional teachers' organization appointed by the State
24    Superintendent of Education.
25        (18) One member representing a professional teachers'
26    organization in a city having a population of over 500,000

1    appointed by the State Superintendent of Education.
2    (c) The Task Force shall first meet at the call of the
3State Superintendent of Education within 90 days after the
4effective date of this amendatory Act of the 101st General
5Assembly, and each subsequent meeting shall be at the call of
6the Chairperson, who shall be elected by a majority of
7appointed members at the first meeting of the Task Force. The
8State Board of Education shall provide administrative and other
9support to the Task Force. Members of the Task Force shall
10serve without compensation, but may be reimbursed for travel
11and related expenses from funds appropriated for that purpose,
12subject to the rules of the appropriate travel control board.
13    (d) The Task Force shall review the best practices for
14preventing the sexual abuse of students in a school-related
15setting or by school-related perpetrators, including school
16district employees or other students, how to best address that
17abuse, and the proper support for students who have suffered
18from that abuse. The review shall examine the best practices at
19all schools maintaining prekindergarten through grade 12,
20regardless of whether the school is a public school, nonpublic
21school, or charter school. On or before January 15, 2020, the
22Task Force must report the findings of its review to the
23Governor and the General Assembly, which must, at a minimum,
24include all of the following topics:
25        (1) The best practices for preventing sexual abuse in
26    school-related settings or by school-related perpetrators,

1    including, but not limited to, criminal history records
2    checks for school district employees, the employment
3    status of a school employee accused of sexual abuse of a
4    student, and procedural safeguards for personnel who
5    regularly interact with children as part of school or
6    school activities, even if the personnel are not officially
7    employed by a school district.
8        (2) The best practices for addressing sexual abuse in a
9    school-related setting or by school-related perpetrators,
10    including, but not limited to, the nature and amount of
11    forensic interviews and forensic interview information
12    sharing, school cooperation with multidisciplinary teams
13    under the Children's Advocacy Center Act, and model school
14    policies.
15        (3) The best practices for support for students who
16    have suffered sexual abuse in a school-related setting or
17    by a school-related perpetrator, including, but not
18    limited to, emotional, psychological, and academic
19    support.
20        (4) Any other topic the Task Force deems necessary to
21    advance the safety or well-being of students in relation to
22    sexual abuse stemming from a school-related setting or
23    school-related perpetrator.
24    The Task Force is dissolved upon submission of the report
25under this subsection.
26    (e) This Section is repealed on July 1, 2020.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
