65 ILCS 5/11-80-24 new

    Amends the Counties Code. Provides that the county board or board of county commissioners of a county may prohibit the sale of and the use of coal tar sealant product and high polycyclic aromatic hydrocarbon sealant product on any surface, except for highway structures, including, but not limited to, a driveway, parking area, playground, sidewalk, bike trail, or roadway within the county. Amends the Municipal Code making similar changes.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1061.5 as follows:
 
6    (55 ILCS 5/5-1061.5 new)
7    Sec. 5-1061.5. Coal tar sealant product and high polycyclic
8aromatic hydrocarbon sealant product.
9    (a) As used in this Section:
10    "Coal tar sealant product" means a surface applied sealing
11product containing any amount of coal tar, coal tar pitch, coal
12tar pitch volatiles, or any variation assigned the Chemical
13Abstracts Service number 65996-93-2, 65996-89-6, or 8007-45-2.
14    "High polycyclic aromatic hydrocarbon sealant product"
15means a surface applied sealing product that contains greater
16than 0.1% polycyclic aromatic hydrocarbons by weight,
17including, but not limited to coal tar pitch volatiles, tar,
18fuel oil, petroleum, or asphalt.
19    (b) The county board or board of county commissioners of a
20county may prohibit the sale of and the use of coal tar sealant
21product and high polycyclic aromatic hydrocarbons sealant
22product on any surface, except for highway structures,
23including, but not limited to, a driveway, parking area,

1playground, sidewalk, bike trail, or roadway within the county.
 
2    Section 10. The Illinois Municipal Code is amended by
3changing Section 11-30-8 and by adding Section 11-80-24 as
4follows:
 
5    (65 ILCS 5/11-30-8)  (from Ch. 24, par. 11-30-8)
6    Sec. 11-30-8. The corporate authorities may prescribe
7rules and regulations for grading and draining of lots and
8construction of (1) paving for motor vehicle driveways and
9parking areas, including, but not limited to, the use of coal
10tar sealant product and high polycyclic aromatic hydrocarbon
11sealant product as provided in Section 11-80-24 of this Code,
12(2) terraces, (3) retaining walls of masonry and other
13materials and for preserving drainage channels in connection
14with building improvements or without such improvements.
