SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1435 new

    Amends the Illinois Vehicle Code. Provides that a person shall not operate a vehicle upon any street, roadway, or highway that is closed due to a rise in water level and is clearly marked by a sign stating the street, roadway, or highway is closed. Provides that a person who violates the new provision is guilty of a Class A misdemeanor and shall be fined up to $2,000. Provides that except for any cost of transporting the rescued person to a hospital or other facility for treatment of injuries, a person shall pay restitution to reimburse costs incurred in a rescue operation. Defines "rescue operation" as a response by a law enforcement officer, an ambulance, a firefighter carried on the rolls of a regularly constituted fire department or fire protection district, a firefighter of a volunteer fire department, or a member of a recognized not-for-profit rescue or emergency medical service provider. Provides that moneys shall be deposited into specific funds if the rescuer is an agent of either the Department of State Police or the Department of Natural Resources.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1435 as follows:
 
6    (625 ILCS 5/11-1435 new)
7    Sec. 11-1435. Flooded roads.
8    (a) As used in this Section, "rescue operation" means a
9response by a law enforcement officer, an ambulance, a
10firefighter carried on the rolls of a regularly constituted
11fire department or fire protection district, a firefighter of a
12volunteer fire department, or a member of a recognized
13not-for-profit rescue or emergency medical service provider.
14    (b) A person shall not operate a vehicle upon any street,
15roadway, or highway in this State if the street, roadway, or
16highway is: (i) closed due to a rise in water level, including,
17but not limited to, groundwater or any overflow of water; and
18(ii) clearly marked by a sign stating that the street, roadway,
19or highway is closed.
20    (c) A person who violates subsection (a) is guilty of a
21Class A misdemeanor and shall be fined up to $2,000. Except for
22any cost of transporting the rescued person to a hospital or
23other facility for treatment of injuries, a person who violates

1subsection (a) shall pay restitution to reimburse costs
2incurred in a rescue operation. If the rescuer is an agent of
3the Department of State Police, the moneys shall be deposited
4into the State Police Operations Assistance Fund. If the
5rescuer is an agent of the Department of Natural Resources, the
6moneys shall be deposited into the Conservation Police
7Operations Assistance Fund.
