SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Open Illinois Checkbook Act. Requires the Comptroller to establish and maintain a publicly accessible database to be known as the "Open Illinois Checkbook" for the purpose of showing all of the expenditures made from any State fund. Provides further requirements for the establishment, use, and operation of the Open Illinois Checkbook. Defines terms. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Open
5Illinois Checkbook Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Expenditure" means any payment, disbursement, or purchase
8made by a State entity.
9    "State entity" means the executive, legislative, and
10judicial branches of the State of Illinois, including its
11departments, divisions, agencies, constitutional offices,
12public bodies, and public universities. The term does not
13include units of local government, school districts, or
14community colleges.
15    "Vendor" means a person or entity that sells, leases, or
16otherwise provides goods and services to any State entity and
17receives reimbursement from that State entity for the goods or
18services provided.
 
19    Section 10. Open Illinois Checkbook.
20    (a) No more than 6 months after the effective date of this
21Act, the Comptroller shall establish and maintain a publicly
22accessible database to be known as the "Open Illinois

1Checkbook" for the purpose of showing all of the expenditures
2made from any State fund. The Open Illinois Checkbook shall be
3maintained within the Internet website operated by the Office
4of the Comptroller, and access shall be free and open to the
5public. All relevant State entities, including, but not limited
6to, the Department of Innovation and Technology, shall consult
7with the Comptroller in the establishment of the Open Illinois
8Checkbook and the fulfillment of the requirements of this Act.
9    (b) Each entry in the Open Illinois Checkbook shall at a
10minimum contain the following information categories, which
11shall be searchable by the user by individual category or
12multiple categories per search:
13        (1) the amount of the expenditure;
14        (2) the date the expenditure was paid;
15        (3) the vendor to which the expenditure was paid;
16        (4) the State entity that made the expenditure; and
17        (5) the salaries of each State employee.
18    The Comptroller may, by administrative rule, provide
19additional information categories to be searchable by users
20under this subsection (b).
21    (c) The Open Illinois Checkbook shall allow users
22downloadable access to the following information:
23        (1) access to a searchable database of all
24    expenditures;
25        (2) access to each expense category of the State,
26    including the Comptroller accounting code, if any, for a

1    specific class of good or service;
2        (3) access to aggregated classes of expenditure data;
3    and
4        (4) access to the total expenditures paid to a specific
5    State vendor or State employee.
6    The Comptroller may, by administrative rule, provide
7access to additional information to be downloadable by users
8under this subsection (c).
9    (d) The Comptroller shall develop and publish graphical
10representations of data contained in the Open Illinois
11Checkbook for the purpose of enhancing and organizing the data
12therein. The Comptroller shall determine the format of these
13graphical representations by administrative rule.
14    (e) The Comptroller shall accept comments from the public
15on the Open Illinois Checkbook and its implementation, and
16shall publish an annual selection of these comments. The
17selection shall reflect public opinion that both praises and
18criticizes the implementation. Nothing in this subsection (e)
19shall require the Comptroller to publish public comments that
20are obscene or otherwise irrelevant to the subject of the Open
21Illinois Checkbook.
22    (f) The Comptroller shall not be required to publish in the
23Open Illinois Checkbook any expenditure that is confidential
24under the terms of the Freedom of Information Act. The
25Comptroller and his or her employees shall be legally protected
26from liability concerning the inadvertent disclosure of a

1confidential record that was posted despite its eligibility to
2be kept confidential under the Freedom of Information Act.
3    (g) No later than the 10th day of each month, each State
4entity shall convey expenditure information to the Comptroller
5for inclusion in the Open Illinois Checkbook concerning
6expenditures made by that State entity during the preceding
7month. Each State entity required to convey information to the
8Comptroller under this subsection (g) shall also provide a link
9on its Internet website to the Open Illinois Checkbook.
10    (h) No later than March 31 of each year, the Comptroller
11shall report on the implementation and the performance of the
12requirements of this Act, including statistics on data made
13available and frequency of public usage. The report shall be
14made available to the public, and copies of the report shall be
15delivered to the Governor, the President and Minority Leader of
16the Senate, the Speaker and Minority Leader of the House of
17Representatives, and the Secretary of State in his or her
18capacity as the Illinois State Librarian.
19    (i) The Comptroller shall adopt any administrative rules
20necessary for the implementation and enforcement of this Act
21under the provisions of the Illinois Administrative Procedure
22Act.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
