SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-20.69 new

    Amends the School Code with respect to school districts other than the Chicago school district. Prohibits any post-retirement educator bonus not required by a valid contract entered into before the effective date of the amendatory Act, and prohibits a school district from entering into a contract on or after the effective date of the amendatory Act that provides for a post-retirement educator bonus or bonuses. Defines "post-retirement educator bonus" as any payment made by a school district to an educator licensed under the School Code who has commenced his or her retirement and is collecting a retirement annuity from the Teachers' Retirement System of the State of Illinois, other than compensation for current employment with the school district. Requires each school district to annually report to all residents of the school district the status of all contracts requiring the payment of a post-retirement educator bonus and all post-retirement educator bonuses paid during the previous school year. Sets forth what the report must contain. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
510-20.69 as follows:
 
6    (105 ILCS 5/10-20.69 new)
7    Sec. 10-20.69. Prohibition on post-retirement educator
8bonuses.
9    (a) In this Section, "post-retirement educator bonus"
10means any payment made by a school district to an educator
11licensed under Article 21B of this Code who has commenced his
12or her retirement and is collecting a retirement annuity from
13the Teachers' Retirement System of the State of Illinois, other
14than compensation for current employment with the school
15district.
16    (b) Any post-retirement educator bonus not required by a
17valid contract entered into before the effective date of this
18amendatory Act of the 101st General Assembly is prohibited, and
19a school district may not enter into a contract on or after the
20effective date of this amendatory Act of the 101st General
21Assembly that provides for a post-retirement educator bonus or
22bonuses.
23    (c) Each school district shall report annually, no later

1than January 31 of each year, to all residents of the school
2district the status of all contracts requiring the payment of a
3post-retirement educator bonus and all post-retirement
4educator bonuses paid during the previous school year. The
5report shall contain both of the following tables:
6        (1) A table summarizing all of the post-retirement
7    educator bonuses paid during the previous school year. This
8    table shall contain the name of each recipient of a
9    post-retirement educator bonus, together with the job
10    title he or she held upon retirement or termination of his
11    or her service with the school district.
12        (2) A table summarizing all contractual obligations of
13    the school district to provide post-retirement educator
14    bonuses in the future.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
