SYNOPSIS AS INTRODUCED:
 
20 ILCS 2505/2505-426 new

    Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that the Director of Revenue shall publish a list containing the name of each member of the General Assembly who (i) has been issued a notice of failure to file a return under the Illinois Income Tax Act more than 180 prior to the date the list is published and (ii) has not filed a return as provided in that notice by the date the list is published. Provides that, if a member of the General Assembly whose name appears on the list subsequently brings himself or herself into compliance with the reporting requirements of the Illinois Income Tax Act, or if that member demonstrates that his or her name appeared on the list in error, then the Director shall promptly remove that member's name from the list. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Revenue Law of the Civil
5Administrative Code of Illinois is amended by adding Section
62505-426 as follows:
 
7    (20 ILCS 2505/2505-426 new)
8    Sec. 2505-426. Disclosure of failure to file by General
9Assembly members.
10    (a) No later than July 1, 2019, and by July 1 of each year
11thereafter, the Director shall publish, in accordance with
12subsection (b), a list containing the name of each member of
13the General Assembly who (i) has been issued a notice of
14failure to file a return under the Illinois Income Tax Act by
15the Department more than 180 prior to the date the list is
16published and (ii) has not filed a return as provided in that
17notice by the date the list is published. If a member of the
18General Assembly whose name appears on the list under this
19Section subsequently brings himself or herself into compliance
20with the reporting requirements of the Illinois Income Tax Act,
21or if that member of the General Assembly demonstrates that his
22or her name appeared on the list in error, then the Director
23shall promptly remove that member's name from the list.

1    (b) The list shall be available for public inspection at
2the Department or by other means of publication, including the
3Internet.
4    (c) The Department shall prescribe reasonable rules for the
5administration and implementation of this Section.
6    (d) Any disclosure made by the Director in a good faith
7effort to comply with this Section, or any disclosure by a
8third party of information contained on the list, shall not be
9considered a violation of any statute prohibiting disclosure of
10taxpayer information.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
