    Amends the Illinois Vehicle Code. Provides that the Secretary of State may issue special registration plates designated as Peace Officers Memorial Foundation of Cook County license plates to active or retired Cook County peace officers and their family members, surviving family members of deceased law enforcement officers, and members of or donors to the Peace Officers Memorial Foundation of Cook County. Provides that the issuance and renewal fee shall be $25. Creates the Peace Officers Memorial Foundation of Cook County Fund. Makes corresponding changes in the Illinois Lottery Law, the State Finance Act, and the Illinois Income Tax Act.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 21.10 as follows:
 
6    (20 ILCS 1605/21.10)
7    Sec. 21.10. Scratch-off for State police memorials.
8    (a) The Department shall offer a special instant
9scratch-off game for the benefit of State police memorials. The
10game shall commence on January 1, 2019 or as soon thereafter,
11at the discretion of the Director, as is reasonably practical.
12The operation of the game shall be governed by this Act and any
13rules adopted by the Department. If any provision of this
14Section is inconsistent with any other provision of this Act,
15then this Section governs.
16    (b) The net revenue from the State police memorials
17scratch-off game shall be deposited into the Criminal Justice
18Information Projects Fund and distributed equally, as soon as
19practical but at least on a monthly basis, to the Chicago
20Police Memorial Foundation Fund, the Police Memorial Committee
21Fund, and the Illinois State Police Memorial Park Fund, and the
22Peace Officers Memorial Foundation of Cook County Fund. Moneys
23transferred to the funds under this Section shall be used,

1subject to appropriation, to fund grants for building and
2maintaining memorials and parks; holding annual memorial
3commemorations; giving scholarships to children of officers
4killed or catastrophically injured in the line of duty, or
5those interested in pursuing a career in law enforcement;
6providing financial assistance to police officers and their
7families when a police officer is killed or injured in the line
8of duty; and providing financial assistance to officers for the
9purchase or replacement of bulletproof bullet proof vests to be
10used in the line of duty.
11    For purposes of this subsection, "net revenue" means the
12total amount for which tickets have been sold less the sum of
13the amount paid out in the prizes and the actual administrative
14expenses of the Department solely related to the scratch-off
15game under this Section.
16    (c) During the time that tickets are sold for the State
17police memorials scratch-off game, the Department shall not
18unreasonably diminish the efforts devoted to marketing any
19other instant scratch-off lottery game.
20    (d) The Department may adopt any rules necessary to
21implement and administer the provisions of this Section.

23    Section 10. The State Finance Act is amended by adding
24Section 5.891 as follows:

2    Sec. 5.891. The Peace Officers Memorial Foundation of Cook
3County Fund.
 
4    Section 15. The Illinois Income Tax Act is amended by
5changing Section 507HHH as follows:

7    Sec. 507HHH. Illinois Police Memorial checkoff.
8    (a) For taxable years ending on or after December 31, 2017,
9the Department must print on its standard individual income tax
10form a provision (i) indicating that if the taxpayer wishes to
11contribute to the Criminal Justice Information Projects Fund,
12as authorized by this amendatory Act of the 100th General
13Assembly, he or she may do so by stating the amount of the
14contribution (not less than $1) on the return and (ii) stating
15that the contribution will reduce the taxpayer's refund or
16increase the amount of payment to accompany the return. Failure
17to remit any amount of increased payment shall reduce the
18contribution accordingly. This Section does not apply to any
19amended return.
20    (b) Moneys deposited into the Criminal Justice Information
21Projects Fund under this Section shall be distributed equally,
22as soon as practical but at least on a monthly basis, to the
23Chicago Police Memorial Foundation Fund, the Police Memorial
24Committee Fund, and the Illinois State Police Memorial Park

1Fund, and the Peace Officers Memorial Foundation of Cook County
2Fund. Moneys transferred to the funds shall be used, subject to
3appropriation, to fund grants for building and maintaining
4memorials and parks; holding annual memorial commemorations;
5giving scholarships to children of officers killed or
6catastrophically injured in the line of duty, or those
7interested in pursuing a career in law enforcement; and
8providing financial assistance to police officers and their
9families when a police officer is killed or injured in the line
10of duty.

12    Section 20. The Illinois Vehicle Code is amended by adding
13Section 3-699.17 as follows:
 
14    (625 ILCS 5/3-699.17 new)
15    Sec. 3-699.17. Peace Officers Memorial Foundation of Cook
16County license plates.
17    (a) The Secretary, upon receipt of all applicable fees and
18applications made in the form prescribed by the Secretary, may
19issue special registration plates designated as Peace Officers
20Memorial Foundation of Cook County license plates to active or
21retired Cook County peace officers and their family members,
22surviving family members of deceased law enforcement officers,
23and members of or donors to the Peace Officers Memorial
24Foundation of Cook County.

1    The special plates issued under this Section shall be
2affixed only to vehicles of the first division or motor
3vehicles of the second division weighing not more than 8,000
4pounds.
5    Plates issued under this Section shall expire according to
6the multi-year procedure established by Section 3-414.1 of this
7Code.
8    (b) The design and color of the plates is wholly within the
9discretion of the Secretary. The Secretary may allow the plates
10to be issued as vanity plates or personalized under Section
113-405.1 of this Code. Appropriate documentation, as determined
12by the Secretary, shall accompany each application. The
13Secretary shall prescribe stickers or decals as provided under
14Section 3-412 of this Code. The Secretary must make a version
15of the special registration plates authorized under this
16Section in a form appropriate for motorcycles.
17    (c) An applicant for the special plate shall be charged a
18$25 fee for original issuance in addition to the appropriate
19registration fee. Of this fee, $10 shall be deposited into the
20Peace Officers Memorial Foundation of Cook County Fund and $15
21shall be deposited into the Secretary of State Special License
22Plate Fund, to be used by the Secretary to help defray the
23administrative processing costs.
24    For each registration renewal period, a $25 fee, in
25addition to the appropriate registration fee, shall be charged.
26Of this fee, $23 shall be deposited into the Peace Officers

1Memorial Foundation of Cook County Fund and $2 shall be
2deposited into the Secretary of State Special License Plate
3Fund.
4    (d) The Peace Officers Memorial Foundation of Cook County
5Fund is created as a special fund in the State treasury. All
6moneys in the Peace Officers Memorial Foundation of Cook County
7Fund shall be paid, subject to appropriation by the General
8Assembly and distribution by the Secretary, as grants to the
9Peace Officers Memorial Foundation of Cook County for
10construction or maintenance of a memorial and park, holding an
11annual memorial commemoration, giving scholarships to children
12of Cook County peace officers killed or catastrophically
13injured in the line of duty, providing financial assistance to
14Cook County peace officers and their families when a Cook
15County peace officer is killed or injured in the line of duty,
16and paying the insurance premiums for Cook County peace
17officers who are terminally ill.
