AMENDMENT TO HOUSE BILL 104

2    AMENDMENT NO. ______. Amend House Bill 104 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Section 2-5009 as follows:
 
6    (55 ILCS 5/2-5009)  (from Ch. 34, par. 2-5009)
7    Sec. 2-5009. Duties and powers of county executive. Any
8county executive elected under this Division shall:
9    (a) see that all of the orders, resolutions and regulations
10of the board are faithfully executed;
11    (b) coordinate and direct by executive order or otherwise
12all administrative and management functions of the county
13government except the offices of elected county officers;
14    (c) prepare and submit to the board for its approval the
15annual budget for the county required by Division 6-1 of this
16Code;

1    (d) appoint, with the advice and consent of the board,
2persons to serve on the various boards and commissions to which
3appointments are provided by law to be made by the board;
4    (e) appoint, with the advice and consent of the board,
5persons to serve on various special districts within the county
6except where appointment to serve on such districts is
7otherwise provided by law;
8    (f) make an annual report to the board on the affairs of
9the county, on such date and at such time as the board shall
10designate, and keep the board fully advised as to the financial
11condition of the county and its future financial needs;
12    (f-5) for a county executive of a county that has adopted
13the executive form of government on or before the effective
14date of this amendatory Act of the 96th General Assembly,
15appoint, with the advice and consent of the board, all
16department heads for any county departments;
17    (g) appoint, with the advice and consent of the board, such
18subordinate deputies, employees and appointees for the general
19administration of county affairs as considered necessary,
20except those deputies, employees and appointees in the office
21of an elected county officer; however, the advice and consent
22requirement set forth in this paragraph shall not apply to: (1)
23persons employed as a member of the immediate personal staff of
24a county executive of a county that has adopted the executive
25form of government on or before the effective date of this
26amendatory Act of the 96th General Assembly, or (2) persons

1appointed by the county executive after the approval of an
2annual budget within the fiscal year of the approved annual
3budget;
4    (h) remove or suspend in his discretion, after due notice
5and hearing, anyone whom he has the power to appoint;
6    (i) require reports and examine accounts, records and
7operations of all county administrative units;
8    (j) supervise the care and custody of all county property
9including institutions and agencies;
10    (k) approve or veto ordinances or resolutions pursuant to
11Section 2-5010;
12    (l) preside over board meetings; however, the county
13executive is not entitled to vote except to break a tie vote;
14    (l-5) for a county executive of a county that has adopted
15the executive form of government on or before the effective
16date of this amendatory Act of the 96th General Assembly, if
17the County Executive is temporarily not available to preside
18over a board meeting, the County Executive shall designate a
19board member to preside over the board meeting;
20    (m) call a special meeting of the county board, by a
21written executive order signed by him and upon 24 hours notice
22by delivery of a copy of such order to the residence of each
23board member;
24    (n) with the advice and consent of the county board, enter
25into intergovernmental agreements with other governmental
26units;

1    (o) with the advice and consent of the county board,
2negotiate on behalf of the county with governmental units and
3the private sector for the purpose of promoting economic growth
4and development;
5    (p) at his discretion, appoint a person to serve as legal
6counsel at an annual salary established by the county board at
7an amount no greater than the annual salary of the state's
8attorney of the county;
9    (q) perform such other duties as shall be required of him
10by the board.

12    Section 99. Effective date. This Act takes effect upon
13becoming law.".
