AMENDMENT TO SENATE BILL 1790

2    AMENDMENT NO. ______. Amend Senate Bill 1790 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Pharmacy Practice Act is amended by adding
5Section 15.3 as follows:
 
6    (225 ILCS 85/15.3 new)
7    Sec. 15.3. Emergency prescription refills.
8    (a) A pharmacist may exercise professional judgment to
9dispense an emergency supply of medication for a chronic
10disease or condition if the pharmacist is unable to obtain
11refill authorization from the prescriber when:
12        (1) in the pharmacist's professional judgment,
13    interruption of therapy might reasonably produce
14    undesirable consequences or cause patient suffering;
15        (2) the pharmacy previously dispensed or refilled a
16    prescription from the prescriber for the same patient and

1    medication;
2        (3) the prescription is not for a controlled substance;
3        (4) the pharmacist informs the patient or the patient's
4    agent at the time of dispensing that prescriber
5    authorization is required for future refills; notification
6    may be made verbally, electronically, or in writing; and
7        (5) the emergency dispensing is documented in the
8    patient's prescription record and the pharmacist informs
9    the prescriber of the emergency refill.
10    (b) The emergency supply must be limited to the amount
11needed for the emergency period as determined by the pharmacist
12within his or her professional judgment. However, the total
13amount dispensed shall not exceed a 30-day supply.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
