AMENDMENT TO SENATE BILL 407

2    AMENDMENT NO. ______. Amend Senate Bill 407 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Uniform Peace Officers' Disciplinary Act is
5amended by changing Section 7.5 as follows:
 
6    (50 ILCS 725/7.5)
7    (Section scheduled to be repealed on December 31, 2018)
8    Sec. 7.5. Commission on Police Professionalism.
9    (a) Recognizing the need to review performance standards
10governing the professionalism of law enforcement agencies and
11officers in the 21st century, the General Assembly hereby
12creates the Commission on Police Professionalism.
13    (b) The Commission on Police Professionalism shall be
14composed of the following members:
15        (1) one member of the Senate appointed by the President
16    of the Senate;

1        (2) one member of the Senate appointed by the Senate
2    Minority Leader;
3        (3) one member of the House of Representatives
4    appointed by the Speaker of the House of Representatives;
5        (4) one member of the House of Representatives
6    appointed by the House Minority Leader;
7        (5) one active duty law enforcement officer who is a
8    member of a certified collective bargaining unit appointed
9    by the Governor;
10        (6) one active duty law enforcement officer who is a
11    member of a certified collective bargaining unit appointed
12    by the President of the Senate;
13        (7) one active duty law enforcement officer who is a
14    member of a certified collective bargaining unit appointed
15    by the Senate Minority Leader;
16        (8) one active duty law enforcement officer who is a
17    member of a certified collective bargaining unit appointed
18    by the Speaker of the House of Representatives;
19        (9) one active duty law enforcement officer who is a
20    member of a certified collective bargaining unit appointed
21    by the House Minority Leader;
22        (10) the Director of State Police, or his or her
23    designee;
24        (10.5) the Superintendent of the Chicago Police
25    Department, or his or her designee;
26        (11) the Executive Director of the Law Enforcement

1    Training Standards Board, or his or her designee;
2        (12) the Director of a statewide organization
3    representing Illinois sheriffs;
4        (13) the Director of a statewide organization
5    representing Illinois chiefs of police;
6        (14) the Director of a statewide fraternal
7    organization representing sworn law enforcement officers
8    in this State;
9        (15) the Director of a benevolent association
10    representing sworn police officers in this State;
11        (16) the Director of a fraternal organization
12    representing sworn law enforcement officers within the
13    City of Chicago; and
14        (17) the Director of a fraternal organization
15    exclusively representing sworn Illinois State Police
16    officers.
17    (c) The President of the Senate and the Speaker of the
18House of Representatives shall each appoint a joint chairperson
19to the Commission. The Department of State Police Law
20Enforcement Training Standards Board shall provide
21administrative support to the Commission.
22    (d) The Commission shall meet regularly to review the
23current training and certification process for law enforcement
24officers, review the duties of the various types of law
25enforcement officers, including auxiliary officers, review the
26standards for the issuance of badges, shields, and other police

1and agency identification, review officer-involved shooting
2investigation policies, review policies and practices
3concerning the use of force and misconduct by law enforcement
4officers, and examine whether law enforcement officers should
5be licensed. For the purposes of this subsection (d), "badge"
6means an officer's department issued identification number
7associated with his or her position as a police officer with
8that Department.
9    (e) The Commission shall submit a report of its findings
10and legislative recommendations to the General Assembly and
11Governor on or before September 30, 2018.
12    (f) This Section is repealed on July 1, 2019 December 31,
132018.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
