1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law of
5the Civil Administrative Code of Illinois is amended by adding
6Section 2105-140 as follows:
 
7    (20 ILCS 2105/2105-140 new)
8    Sec. 2105-140. Licensing of noncitizens.
9    (a) No person shall be prohibited from receiving a license
10solely because he or she is not a citizen of the United States.
11    (b) The Department may grant a license to a person who, in
12addition to fulfilling the requirements of the State licensing
13Act that applies to his or her profession, satisfies the
14following requirements:
15        (1) the United States Department of Homeland Security
16    has approved the person's request for Deferred Action for
17    Childhood Arrivals;
18        (2) the person's Deferred Action for Childhood
19    Arrivals has not expired or has been properly renewed; and
20        (3) the person has a current and valid employment
21    authorization document issued by the United States
22    Citizenship and Immigration Service.
23    The General Assembly finds and declares that this Section

1is a State law within the meaning of subsection (d) of Section
21621 of Title 8 of the United States Code.
3    (c) The Department may adopt any rules necessary to
4implement this amendatory Act of the 100th General Assembly.
 
5    Section 10. The Pharmacy Practice Act is amended by
6changing Section 6 as follows:
 
7    (225 ILCS 85/6)  (from Ch. 111, par. 4126)
8    (Section scheduled to be repealed on January 1, 2018)
9    Sec. 6. Each individual seeking licensure as a registered
10pharmacist shall make application to the Department and shall
11provide evidence of the following:
12    1. (blank); that he or she is a United States citizen or
13legally admitted alien;
14    2. that he or she has not engaged in conduct or behavior
15determined to be grounds for discipline under this Act;
16    3. that he or she is a graduate of a first professional
17degree program in pharmacy of a university recognized and
18approved by the Department;
19    4. that he or she has successfully completed a program of
20practice experience under the direct supervision of a
21pharmacist in a pharmacy in this State, or in any other State;
22and
23    5. that he or she has passed an examination recommended by
24the Board of Pharmacy and authorized by the Department.

1    The Department shall issue a license as a registered
2pharmacist to any applicant who has qualified as aforesaid and
3who has filed the required applications and paid the required
4fees in connection therewith; and such registrant shall have
5the authority to practice the profession of pharmacy in this
6State.
