SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.42 new

    Amends the Chicago School District Article of the School Code. Requires the school board to establish a fund to compensate students who, for school years 2015-2016 through 2017-2018, were improperly denied special education services or had special education services improperly delayed. Requires the board to contribute a minimum of $10,000,000 to the fund. Requires the board to advertise the availability of the fund by posting information about the fund on the school district's Internet website, advertising in a newspaper of general circulation in the district, and advertising on social media. Requires the advertisements to include certain information. Provides that the school board shall obtain the State Board of Education's approval regarding the content of the advertisements and regarding the scope of the school board's advertising efforts to ensure that the advertising efforts are, to the extent possible, sufficient to reach as many parents and legal guardians of eligible students as possible. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
534-18.60 as follows:
 
6    (105 ILCS 5/34-18.60 new)
7    Sec. 34-18.60. Fund to compensate certain students
8improperly denied special education services.
9    (a) The board shall establish a fund to compensate students
10who, for school years 2015-2016 through 2017-2018, were
11improperly denied special education services or had special
12education services improperly delayed. The board shall
13contribute a minimum of $10,000,000 to the fund.
14    (b) The board shall, at a minimum, advertise the
15availability of the fund by posting information about the fund
16on the school district's Internet website, advertising in a
17newspaper of general circulation in the district, and
18advertising on social media. The advertisements shall include,
19but not be limited to, a description of the fund and its
20purpose and how parents and legal guardians of eligible
21students may seek compensation from the fund. The board shall
22obtain the State Board of Education's approval regarding the
23content of the advertisements and regarding the scope of the

1board's advertising efforts to ensure that the advertising
2efforts are, to the extent possible, sufficient to reach as
3many parents and legal guardians of eligible students as
4possible.
 
5    Section 90. The State Mandates Act is amended by adding
6Section 8.42 as follows:
 
7    (30 ILCS 805/8.42 new)
8    Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
9of this Act, no reimbursement by the State is required for the
10implementation of any mandate created by this amendatory Act of
11the 100th General Assembly.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
