SYNOPSIS AS INTRODUCED:
 
820 ILCS 405/901.1

    Amends the Unemployment Insurance Act. Provides that the additional penalty for fraudulently obtaining benefits is 125% (instead of 15%) of the amount fraudulently obtained. Provides that the amounts collected shall be paid into the State's account in the Unemployment Trust Fund (instead of shall be treated in the same manner as benefits recovered from an individual). Effective immediately.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Unemployment Insurance Act is amended by
5changing Section 901.1 as follows:
 
6    (820 ILCS 405/901.1)
7    Sec. 901.1. Additional penalty. In addition to the
8penalties imposed under Section 901, an individual who, for the
9purposes of obtaining benefits, knowingly makes a false
10statement or knowingly fails to disclose a material fact, and
11thereby obtains any sum as benefits for which he or she is not
12eligible, shall be required to pay a penalty in an amount equal
13to 125% 15% of such sum. All of the provisions of Section 900
14applicable to the recovery of sums described in paragraph 1 of
15subsection A of Section 900 shall apply to penalties imposed
16pursuant to this Section. All penalties collected under this
17Section shall be paid into the State's account in the
18Unemployment Trust Fund treated in the same manner as benefits
19recovered from such individual.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
