SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.42 new

    Amends the University Credit and Retail Sales Act. Changes the short title of the Act to the Higher Education Institution Credit and Retail Sales Act. Defines "State institution of higher learning" to mean a university, college, community college, or junior college in this State that is publicly supported by taxes levied and collected within the State on income, sales, or property. Provides that "State institution of higher learning" does not include a post-secondary educational institution as defined under the Private College Act. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1    AN ACT concerning higher education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University Credit and Retail Sales Act is
5amended by changing Section 0.01 and adding Section 0.05 as
6follows:
 
7    (110 ILCS 115/0.01)  (from Ch. 144, par. 251.9)
8    Sec. 0.01. Short title. This Act may be cited as the Higher
9Education Institution University Credit and Retail Sales Act.

12    Sec. 0.05. State institution of higher learning defined.
13"State institution of higher learning" means a university,
14college, community college, or junior college in this State
15that is publicly supported by taxes levied and collected within
16the State on income, sales, or property. "State institution of
17higher learning" does not include a post-secondary educational
18institution as defined under the Private College Act.
 
19    Section 90. The State Mandates Act is amended by adding
20Section 8.42 as follows:

1    (30 ILCS 805/8.42 new)
2    Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
3of this Act, no reimbursement by the State is required for the
4implementation of any mandate created by this amendatory Act of
5the 100th General Assembly.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
