SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-805.10 new

    Amends the Illinois Vehicle Code. Defines "automated driving system", "autonomous vehicle", "driver", "dynamic driving task", "Level 3 automated driving system", "Level 4 automated driving system", and "Level 5 automated driving system". Provides that the Secretary of State shall develop a unique registration plate to identify an autonomous vehicle of 12,000 pounds or less. Provides that the unique registration plate shall have the same registration fee as vehicles of the second division based on the weight of the vehicle. Provides that prior to the issuance of any registration to an autonomous motor vehicle, the owner of an autonomous motor vehicle shall provide proof of insurance to the Secretary by providing either a certificate of insurance or a surety bond to be posted with the Secretary in an amount no less than $1,000,000 and no more than $5,000,000. Provides that the Secretary shall adopt any rules necessary to implement this Act. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 3-805.10 as follows:
 
6    (625 ILCS 5/3-805.10 new)
7    Sec. 3-805.10. Autonomous vehicles.
8    (a) As used in this Section:
9    "Automated driving system" means a motor vehicle's
10hardware and software that is collectively capable of
11performing the entire dynamic driving task on a sustained
12basis, regardless of whether the system is limited to a
13specific operational design domain, in a reasonably safe
14manner.
15    "Autonomous vehicle" means a motor vehicle equipped with a
16Level 3, 4, or 5 automated driving system, as defined in SAE
17J3016.
18    "Driver" means an individual person who has a valid
19driver's license issued under this Code or another recognized
20jurisdiction.
21    "Dynamic driving task" means the operation and tactical
22aspects of driving or operating a motor vehicle. "Dynamic
23driving task" does not include the strategic aspects, such as

1determining destinations or routes, of operating a motor
2vehicle.
3    "Level 3 automated driving system" means the driving
4mode-specific performance by an automated driving system of all
5aspects of the dynamic driving task with the expectation that
6the human driver will respond appropriately to a request to
7intervene.
8    "Level 4 automated driving system" means the driving
9mode-specific performance by an automated driving system of all
10aspects of the dynamic driving task, even if a human driver
11does not respond appropriately to a request to intervene.
12    "Level 5 automated driving system" means the full-time
13performance by an automated driving system of all aspects of
14the dynamic driving task under all roadway and environmental
15conditions that can be managed by a human driver.
16    (b) The Secretary shall develop a unique registration plate
17to identify an autonomous vehicle of 12,000 pounds or less. The
18unique registration plate shall, in accordance with the
19registration fees based on weight set forth in Section 3-815 of
20this Code, be issued or renewed on an annual basis.
21    (c) Prior to the issuance of any registration to an
22autonomous motor vehicle, the owner of an autonomous vehicle
23shall provide proof of insurance to the Secretary by providing
24either a certificate of insurance or a surety bond; the
25certificate of insurance or surety bond is to be posted with
26the Secretary of State in the amount to be set by rule, but in

1an amount no less than $1,000,000 nor more than $5,000,000.
2    (d) The Secretary of State shall adopt any rules necessary
3to implement this Section.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
