AMENDMENT TO HOUSE BILL 4707

2    AMENDMENT NO. ______. Amend House Bill 4707 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Prescription Drug Task Force Act.
 
6    Section 5. Purpose. The General Assembly finds that:
7    (1) Prescription opioid abuse is endemic in this State.
8    (2) Many prescribers in this State over-prescribe Schedule
9II controlled substances such as Hydrocodone and Oxycodone for
10pain relief that are classified as opiates.
11    (3) Some medical studies have shown that the use of opioid
12versus non-opioid medication therapy did not result in
13significantly better pain-related function over the trial
14periods.
15    (4) It has the right to regulate the licensing of medical
16professionals and has enacted various licensing Acts for that

1purpose authorizing the Department of Financial and
2Professional Regulation to license and discipline these
3medical professionals.
4    (5) A legislative Task Force is necessary to study the
5extent of over prescription of opioids to patients, and to make
6recommendations of future legislation to address this issue.
 
7    Section 10. Prescription Drug Task Force.
8    (a) The Prescription Drug Task Force is created. The Task
9Force shall be composed of 19 members appointed as follows:
10        (1) one member of the House of Representatives
11    appointed by the Speaker of the House of Representatives;
12        (2) one member of the House of Representatives
13    appointed by the Minority Leader of the House of
14    Representatives;
15        (3) one member of the Senate appointed by the President
16    of the Senate;
17        (4) one member of the Senate appointed by the Minority
18    Leader of the Senate;
19        (5) the Secretary of Human Services or his or her
20    designee;
21        (6) one member from each of the following organizations
22    appointed by the Secretary of Human Services from nominees
23    made by the respective organization:
24            (A) a statewide organization representing advanced
25        practice nursing;

1            (B) a statewide organization representing
2        hospitals;
3            (C) a statewide organization representing retail
4        merchants;
5            (D) a statewide organization representing
6        dentists;
7            (E) a statewide organization representing
8        physicians;
9            (F) a statewide organization representing
10        health-system pharmacists;
11            (G) a statewide organization representing
12        optometrists;
13            (H) a statewide organization representing
14        pharmacists; and
15            (I) a statewide organization representing
16        pharmaceutical manufacturers;
17        (7) 2 members who are parents whose children have died
18    from drug overdoses, appointed by the Secretary of Human
19    Services;
20        (8) 2 members who are selected from county sheriffs,
21    municipal police chiefs, and State's Attorneys, appointed
22    by the Attorney General; and
23        (9) one member who is a peace officer specializing in
24    the enforcement of laws prohibiting the illegal
25    manufacture, delivery, and possession of controlled
26    substances and methamphetamine, appointed by the Director

1    of State Police.
2.    (b) The Task Force shall choose its chairperson from among
3its members and any other officers it deems appropriate.
4    (c) The Task Force shall initially meet within 30 days
5after the effective date of this Act. The members of the Task
6Force shall receive no compensation for their services as
7members of the Task Force but may be reimbursed for expenses
8from appropriations made by law.
9    (d) The Task Force may seek the assistance of the
10Departments of Financial and Professional Regulation and
11Public Health in performing its duties.
12    (e) The Task Force shall:
13        (1) study prescription opioid abuse in this State;
14        (2) study the over-prescription of opioids such as
15    Hydrocodone and Oxycodone;
16        (3) recommend whether restrictions on prescriptions of
17    opioids should be enacted by the General Assembly; and
18        (4) recommend any other legislation, including
19    amendments to the Illinois Controlled Substances Act, that
20    would have the effect of reducing opioid addiction and
21    abuse.
22    (f) The Task Force shall focus its efforts in a manner that
23best utilizes the unique skills and perspectives of the experts
24on the Task Force.
25    (g) After completion of its duties, the Task Force shall
26report its recommendations to the General Assembly. The report

1to the General Assembly shall be filed with the Clerk of the
2House of Representatives and the Secretary of the Senate in
3electronic form only, in the manner that the Clerk and the
4Secretary shall direct.
5    (h) The Department of Human Services shall provide
6administrative and other support to the Task Force.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
