SYNOPSIS AS INTRODUCED:
 
70 ILCS 705/11f  from Ch. 127 1/2, par. 31f

    Amends the Fire Protection District Act. In provisions regarding fixing, charging, and collecting fees for services rendered by a fire district against persons, businesses, and other entities who are not residents of the fire protection district, provides that additional charges may be levied to reimburse the district for equipment and apparatus utilized in response to the call for assistance where it can be demonstrated by the district that the additional equipment or apparatus was needed in the circumstances presented, but the rate per vehicle shall not exceed $100 per hour. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fire Protection District Act is amended by
5changing Section 11f as follows:
 
6    (70 ILCS 705/11f)  (from Ch. 127 1/2, par. 31f)
7    Sec. 11f. Charge against non-residents.
8    (a) The board of trustees of a fire protection district may
9fix, charge, and collect fees not exceeding the reasonable cost
10of the service for all services rendered by the district
11against persons, businesses and other entities who are not
12residents of the fire protection district.
13    (b) Such charge may not be assessed against residents of
14the fire protection district or persons who request fire
15protection coverage for an unprotected area and who pay to the
16fire protection district an amount equal to the district's Fire
17Protection Tax pursuant to Section 4 of the Fire Protection of
18Unprotected Area Act.
19    (c) The charge for such services shall be computed at a
20rate not to exceed $250 per hour and not to exceed $70 per hour
21per firefighter responding to a call for assistance. An
22additional charge may be levied to reimburse the district for
23(1) extraordinary expenses of materials used in rendering such

1services or (2) equipment and apparatus utilized in response to
2the call for assistance where it can be demonstrated by the
3district that the additional equipment or apparatus was needed
4in the circumstances presented, but the rate per vehicle shall
5not exceed $100 per hour. No charge shall be made for services
6for which the total charge would be less than $50.
7    (d) All revenue from the charges assessed pursuant to this
8Section shall be deposited to the general fund of the fire
9protection district.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
