AMENDMENT TO HOUSE BILL 4242

2    AMENDMENT NO. ______. Amend House Bill 4242 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Freedom of Information Act is amended by
5adding Section 2.25 as follows:
 
6    (5 ILCS 140/2.25 new)
7    Sec. 2.25. Sexual harassment and sexual discrimination
8severance agreements.
9    (a) A unit of local government, school district, community
10college district, or other local taxing body shall provide
11notice to the public as specified in this Section if the unit
12of local government, school district, community college
13district, or other local taxing body enters into a severance,
14separation, or other agreement with an employee or contractor
15accused of sexual harassment, as defined in Section 2-101 of
16the Illinois Human Rights Act, or sexual discrimination, as

1defined by federal law, and the change in employment status
2leading to the severance, separation, or other agreement is
3causally related to the accusation of sexual harassment or
4sexual discrimination.
5    (b) No more than 72 hours after payment has been made by or
6on behalf of the unit of local government, school district,
7community college district, or other local taxing body under a
8severance, separation, or other agreement described by
9subsection (a), the unit of local government, school district,
10community college district, or other local taxing body shall
11publish on its Internet website and cause to be published once
12per week for 5 consecutive weeks in a newspaper published in
13the jurisdiction of the unit of local government, school
14district, community college district, or other local taxing
15body the following information:
16        (1) the name of the person receiving the payment;
17        (2) the amount of the payment;
18        (3) the fact that the person receiving the payment has
19    been accused of sexual harassment or sexual
20    discrimination, as the case may be; and
21        (4) whether the employee or contractor has admitted to
22    the alleged sexual harassment or sexual discrimination.
23    (c) No unit of local government, school district, community
24college district, or other local taxing body shall incur
25liability as a result of any injury or other damages arising
26from its compliance with this Section.

1    (d) Nothing this Section shall abridge any contractual
2status of employer-employee confidentiality.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
