1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Bedbug
5Inspection Act.
 
6    Section 5. Definitions. In this Act:
7    "Merchant" means a person who, in the ordinary course of
8business, regularly rents or leases furniture or electronic
9equipment to customers, but does not include a person who
10offers any lease that is automatically renewable with each
11payment after the initial period and that permits the consumer
12to become the owner of the merchandise.
13    "Pest" means undesirable insects including, but not
14limited to, bedbugs and roaches.
15    "Rent" means the transfer of possession property or right
16of possession property for consideration.
 
17    Section 10. Inspection. A merchant must inspect any
18previously rented furniture and equipment before renting the
19furniture or equipment to a subsequent customer.
 
20    Section 15. Treatment required. If an inspection reveals
21the presence of pests, the merchant must treat the furniture or

1equipment to eradicate the pests before renting the furniture
2or equipment to a subsequent customer.
 
3    Section 20. Action for damages. A person who suffers
4damages caused by a merchant's violation of this Act and
5reports the presence of a pest to the merchant within 45 days
6after the beginning of the rental may bring an action pursuant
7to Section 10a of the Consumer Fraud and Deceptive Business
8Practices Act under the standards applicable to the holder of a
9retail installment contract.
