1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 21.2 as follows:
 
6    (415 ILCS 5/21.2)  (from Ch. 111 1/2, par. 1021.2)
7    Sec. 21.2. (a) After June 30, 1988, no person may sell or
8offer for sale at retail in this State any metal beverage
9container acquired by the seller or retailer after that date
10which is designed and constructed in such a manner that a part
11of the container is detachable in opening the container without
12the aid of a can opener, unless the part comprises
13substantially all of one of the ends of the metal beverage
14container.
15    (b) For purposes of this Section:
16    (1) "Beverage" means beer or other malt beverages, mineral
17water, soda water or carbonated soft drinks, in liquid form and
18intended for human consumption.
19    (2) "Metal beverage container" means any can or other
20container which is composed exclusively or predominantly of
21metal or metallic alloys (except those sold to interstate
22common carriers for use in passenger service) and which
23contains or did contain a beverage.

1    (c) Any person who violates this Section is guilty of a
2business offense and shall be subject to a fine of $500 for the
3first such violation. Any person who violates this Section a
4second or subsequent time shall be guilty of a business offense
5and shall be subject to a fine of $2,000.
