1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Local
5Initiative Sunshine Act.
 
6    Section 5. Purpose. The purpose of this Act is to provide
7full and complete disclosure to the public of the recipients of
8local initiatives.
 
9    Section 10. Definitions. As used in this Act:
10    "Local initiative" means an enacted appropriation to a
11specific unit of local government, specific school district,
12specific not-for-profit organization, or specific
13non-governmental entity to provide a grant of State funds for
14infrastructure improvements or operating expenses. Grants that
15are part of a Statewide program and are based on generally
16applicable standards of eligibility are not local initiatives.
17    "Infrastructure improvements" include without limitation
18capital improvements, capital projects, planning,
19construction, reconstruction, equipment, utilities, vehicles,
20and all costs associated with economic development, community
21programs, educational programs, public health, and public
22safety.

1    "Initiative recipient" means an individual or entity that
2is designated to receive or receives a local initiative.
3    "Searchable database website" means a website that allows
4the public to (i) search the database by name of initiative
5recipient, funding agency, and location; and (ii) download data
6included in item (i), including outcomes from searches.
 
7    Section 15. Initiative recipient database.
8    (a) Beginning on January 1, 2018, the Office of the
9Comptroller shall create and maintain a searchable database
10website containing information concerning initiative
11recipients. The database shall include for each initiative
12recipient:
13        (1) the name of the initiative recipient;
14        (2) the location of the initiative recipient and the
15    primary location of the performance of the local
16    initiative;
17        (3) the State Representative and State Senator within
18    whose legislative district the primary location of the
19    performance of the local initiative is located;
20        (4) the amount of the local initiative;
21        (5) the funding agency and the funding source;
22        (6) the purpose of each local initiative; and
23        (7) the portion of the local initiative spent by the
24    initiative recipient, and the portion that lapsed upon
25    completion of the local initiative.

1    (b) Funding agencies shall be responsible for submitting
2the information required by subsection (a) of this Section to
3the Comptroller, in a form to be prescribed by the Comptroller.
4    (c) The database website shall also provide an opportunity
5for the public to provide input about the utility of the
6website and recommendations for improvements.
7    (d) The database website shall not be considered in
8compliance with this Act if it relies upon links to other
9existing websites and databases, unless each of those sites has
10information from all agencies and each category of information
11required to be itemized can be searched electronically by field
12in a single search.
13    (e) The database website must contain a summary of the
14requirements of the Grant Accountability and Transparency Act
15and the Illinois Grant Funds Recovery Act, to the extent the
16requirements of those Acts will apply to the funding
17initiatives.
 
18    Section 99. Effective date. This Act takes effect January
191, 2018.
