SYNOPSIS AS INTRODUCED:

105 ILCS 25/1.25 new

    Amends the Department of State Police Law of the Civil Administrative Code of Illinois and the Interscholastic Athletic Organization Act. Requires each applicant seeking licensure or certification by an interscholastic athletic organization to be a game official and each person renewing such licensure or certification on or after the effective date of the amendatory Act to authorize a fingerprint-based criminal history records check to determine whether the person has committed a disqualifying offense. Sets forth the records check procedure. Requires the interscholastic athletic organization to further check the person's information against the Statewide Sex Offender Database and the Statewide Murderer and Violent Offender Against Youth Database. Prohibits an interscholastic athletic organization from licensing or certifying a person as a game official or renewing a game official's license or certificate if that person has not undergone a criminal history records check or has committed an offense requiring the person to register as a sex offender under the Sex Offender Registration Act or as a violent offender against youth under the Murderer and Violent Offender Against Youth Registration Act. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by adding Section
62605-326 as follows:
 
7    (20 ILCS 2605/2605-326 new)
8    Sec. 2605-326. Conviction information for interscholastic
9athletic organization. To conduct a fingerprint-based criminal
10history records check pursuant to Section 1.25 of the
11Interscholastic Athletic Organization Act. The Department
12shall furnish the conviction information to the
13interscholastic athletic organization.
 
14    Section 10. The Interscholastic Athletic Organization Act
15is amended by adding Section 1.25 as follows:
 
16    (105 ILCS 25/1.25 new)
17    Sec. 1.25. Game officials; criminal history.
18    (a) As used in this Section:
19    "Department" means the Department of State Police.
20    "Game official" means a person who officiates at an
21athletic activity, such as a referee or umpire, including, but

1not limited to, persons enrolled as game officials by the
2Illinois High School Association or Illinois Elementary School
3Association.
4    "Interscholastic athletic organization" means an
5association or other entity that has as one of its purposes
6promoting, sponsoring, regulating, or in any manner providing
7for interscholastic athletics or any form of athletic
8competition among schools and students within this State.
9    (b) Each applicant seeking licensure or certification by an
10interscholastic athletic organization to be a game official and
11each person renewing such licensure or certification on or
12after the effective date of this amendatory Act of the 100th
13General Assembly shall authorize a fingerprint-based criminal
14history records check to determine whether the person has
15committed a disqualifying offense. The person shall submit his
16or her fingerprints and any other required information to the
17Department in the form and manner prescribed by the Department.
18These fingerprints shall be checked against the fingerprint
19records now and hereafter filed in the Department's and Federal
20Bureau of Investigation's criminal history records databases.
21The Department and the Federal Bureau of Investigation shall
22furnish, pursuant to the fingerprint-based criminal history
23records check, records of convictions, until expunged, to the
24interscholastic athletic organization. The Department shall
25charge a fee for conducting the criminal history records check,
26which shall be deposited in the State Police Services Fund and

1shall not exceed the actual cost of the criminal history
2records check. Each person shall be responsible for the cost of
3the criminal history records check. The interscholastic
4athletic organization shall further check the person's
5information against the Statewide Sex Offender Database and the
6Statewide Murderer and Violent Offender Against Youth
7Database.
8    (c) An interscholastic athletic organization may not
9license or certify a person as a game official or renew a game
10official's license or certificate if that person has not
11undergone a criminal history records check under subsection (b)
12of this Section or has committed an offense requiring the
13person to register as a sex offender under the Sex Offender
14Registration Act or as a violent offender against youth under
15the Murderer and Violent Offender Against Youth Registration
16Act.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
