SYNOPSIS AS INTRODUCED:
 
20 ILCS 1305/1-65 new

    Amends the Department of Human Services Act. Requires each geographically organized service region operating under the Department of Human Services' Division of Mental Health to submit by July 1 of each year, beginning in 2018, an annual foster care mental health service plan to the Department that details the service array, from prevention to crisis services, available to Medicaid-eligible children and youth in foster care. Sets forth the data and information the service plans shall contain, including: (1) the number of Medicaid-eligible children and youth in foster care who are served in the region's service area each year; (2) details on the types of mental health services provided to children and youth in foster care and their families, which may include, but are not limited to, screenings, assessments, home-based mental health services, outpatient services, day treatment services, inpatient services, psychiatric hospitalizations, crisis interventions, case management, or psychotropic medication support services; and (3) medication monitoring consistent with any child welfare psychotropic medication measures developed by the Department of Children and Family Services and any Healthcare Effectiveness Data and Information Set (HEDIS) measures related to psychotropic medications. Requires the Department of Human Services to (i) post each foster care mental health service plan on its Internet website in a manner that is publicly accessible and (ii) share performance outcome system data with the regional administrator of each service region for the purpose of informing foster care mental health service plans.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. The Department of Human Services Act is amended
5by adding Section 1-65 as follows:
 
6    (20 ILCS 1305/1-65 new)
7    Sec. 1-65. Foster care mental health service plans.
8    (a) Each geographically organized service region operating
9under the Department's Division of Mental Health shall submit
10an annual foster care mental health service plan to the
11Department that details the service array, from prevention to
12crisis services, available to Medicaid-eligible children and
13youth in foster care. Service plans shall be submitted by July
141 of each year, beginning in 2018, and shall include, but not
15be limited to, all of the following elements:
16        (1) The number of Medicaid-eligible children and youth
17    in foster care who are served in the region's service area
18    each year.
19        (2) The number of family members, including foster
20    parents, of children and youth in foster care who are
21    served in the region's service area.
22        (3) Details on the types of mental health services
23    provided to children and youth in foster care and their

1    families, including prevention and treatment services.
2    These types of services may include, but are not limited
3    to, screenings, assessments, home-based mental health
4    services, outpatient services, day treatment services,
5    inpatient services, psychiatric hospitalizations, crisis
6    interventions, case management, or psychotropic medication
7    support services.
8        (4) Access to, and timeliness of, mental health
9    services available to Medicaid-eligible children and youth
10    in foster care.
11        (5) Quality of mental health services available to
12    Medicaid-eligible children and youth in foster care.
13        (6) Translation and interpretation services available
14    to Medicaid-eligible children and youth in foster care.
15        (7) Coordination with other systems, including
16    regional centers, special education local plan areas,
17    child welfare, and probation.
18        (8) Family and caregiver education and support.
19        (9) Performance data for Medicaid-eligible children
20    and youth in foster care.
21        (10) Utilization data for Medicaid-eligible children
22    and youth in foster care.
23        (11) Medication monitoring consistent with any child
24    welfare psychotropic medication measures developed by the
25    Department of Children and Family Services and any
26    Healthcare Effectiveness Data and Information Set (HEDIS)

1    measures related to psychotropic medications, including,
2    but not limited to, the following:
3            (A) Follow-up care for children prescribed
4        attention deficit hyperactivity disorder medication
5        (HEDIS ADD).
6            (B) Use of multiple concurrent antipsychotics in
7        children and adolescents (HEDIS APC).
8            (C) Use of first-line psychosocial care for
9        children and adolescents on antipsychotics (HEDIS
10        APP).
11            (D) Metabolic monitoring for children and
12        adolescents on antipsychotics (HEDIS APM).
13    (b) The Department shall post each foster care mental
14health service plan on its Internet website in a manner that is
15publicly accessible.
16    (c) To the extent possible, the Department shall share with
17the regional administrator of each service region data that
18will assist in the development of foster care mental health
19service plans.
20    (d) The Department shall annually share performance
21outcome system data with the regional administrator of each
22service region for the purpose of informing foster care mental
23health service plans. Performance outcome system data shared
24with regional administrators shall include, but not be limited
25to, the following disaggregated data for Medicaid-eligible
26children and youth in foster care:

1        (1) The number of youth receiving specialty mental
2    health services.
3        (2) The racial distribution of youth receiving
4    specialty mental health services.
5        (3) The gender distribution of youth receiving
6    specialty mental health services.
7        (4) The number of youth, by race, with one or more
8    specialty mental health service visits.
9        (5) The number of youth, by race, with 5 or more
10    specialty mental health service visits.
11        (6) Utilization data for intensive home services,
12    intensive care coordination, case management, therapeutic
13    behavioral services, medication support services, crisis
14    intervention, crisis stabilization, full-day intensive
15    treatment, full-day treatment, full-day rehabilitation,
16    and hospital inpatient days.
17        (7) A unique count of youth receiving specialty mental
18    health services who are arriving, exiting, and continuing
19    with services.
20    (e) The Department shall ensure that the performance
21outcome system data metrics provided under subsection (d)
22include disaggregated data for Medicaid-eligible children and
23youth in foster care. The data shall be in a format that can be
24analyzed.
