AMENDMENT TO HOUSE BILL 165

2    AMENDMENT NO. ______. Amend House Bill 165 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Pension Code is amended by
5changing Sections 4-103 and 7-109.3 as follows:
 
6    (40 ILCS 5/4-103)  (from Ch. 108 1/2, par. 4-103)
7    Sec. 4-103. Municipality. "Municipality": (1) Except as
8otherwise provided in this Section, any Any city, township,
9village or incorporated town of 5,000 or more but less than
10500,000 inhabitants, and any fire protection district having
11any full-time paid firefighters, and (2) any city, village,
12incorporated town or township of less than 5,000 inhabitants
13having a full-time paid fire department which adopts the
14provisions of this article pursuant to the provisions of
15Section 4-141. "Municipality" does not include any village with
16a population of 8,250 inhabitants or more, but not more than

18,260 inhabitants, as reported by the United States Census
2Bureau in the 2010 Census of Population, so long as that
3village has less than 2 full-time paid firefighters. The term
4"city council" or "board of trustees" includes the board of
5trustees of a fire protection district and the board of town
6trustees or other persons empowered to draft the tentative
7budget and appropriation ordinance and the electors of such a
8township acting at the annual or special meeting of town
9electors.

12    Sec. 7-109.3. "Sheriff's Law Enforcement Employees".
13    (a) "Sheriff's law enforcement employee" or "SLEP" means:
14        (1) A county sheriff and all deputies, other than
15    special deputies, employed on a full time basis in the
16    office of the sheriff.
17        (2) A person who has elected to participate in this
18    Fund under Section 3-109.1 of this Code, and who is
19    employed by a participating municipality to perform police
20    duties.
21        (3) A law enforcement officer employed on a full time
22    basis by a Forest Preserve District, provided that such
23    officer shall be deemed a "sheriff's law enforcement
24    employee" for the purposes of this Article, and service in
25    that capacity shall be deemed to be service as a sheriff's

1    law enforcement employee, only if the board of
2    commissioners of the District have so elected by adoption
3    of an affirmative resolution. Such election, once made, may
4    not be rescinded.
5        (4) A person not eligible to participate in a fund
6    established under Article 3 of this Code who is employed on
7    a full-time basis by a participating municipality or
8    participating instrumentality to perform police duties at
9    an airport, but only if the governing authority of the
10    employer has approved sheriff's law enforcement employee
11    status for its airport police employees by adoption of an
12    affirmative resolution. Such approval, once given, may not
13    be rescinded.
14        (5) A person who is employed as a full-time firefighter
15    by a participating municipality that (i) has not
16    established a fund under Article 4 of this Code and (ii) is
17    a village with a population of 8,250 inhabitants or more,
18    but not more than 8,260 inhabitants, as reported by the
19    United States Census Bureau in the 2010 Census of
20    Population.
21    (b) An employee who is a sheriff's law enforcement employee
22and is granted military leave or authorized leave of absence
23shall receive service credit in that capacity. Sheriff's law
24enforcement employees shall not be entitled to out-of-State
25service credit under Section 7-139.
