Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides for a minimum monthly personal needs allowance, subject to appropriation, for
persons who are inpatients in a facility licensed under the ID/DD Community Care Act and who are eligible for Medicaid. Provides that the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act, so that the person's total monthly personal needs allowance from both State and federal sources equals $50. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 5-31 as follows: |
6 | | (305 ILCS 5/5-31 new) |
7 | | Sec. 5-31. Personal needs allowance. Subject to |
8 | | appropriation, for a person who is an inpatient in a facility |
9 | | licensed under the ID/DD Community Care Act for which payments |
10 | | are made under this Article throughout a month and who is |
11 | | determined to be eligible for medical assistance under this |
12 | | Article, the State shall pay an amount in addition to the |
13 | | minimum monthly personal needs allowance authorized under |
14 | | Section 1902(q) of Title XIX of the Social Security Act (42 |
15 | | U.S.C. 1396a(q)), so that the person's total monthly personal |
16 | | needs allowance from both State and federal sources equals $50.

17 | | Section 99. Effective date. This Act takes effect upon |
18 | | becoming law.
