AMENDMENT TO HOUSE BILL 31

2    AMENDMENT NO. ______. Amend House Bill 31 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Section 3-5047 as follows:
 
6    (55 ILCS 5/3-5047)
7    Sec. 3-5047. Removal of personal information.
8    (a) Upon request by any person, the recorder shall redact
9or remove that person's social security number, employer
10taxpayer identification number, driver's license number, State
11identification number, passport number, checking account
12number, savings account number, credit card number, debit card
13number, or personal identification (PIN) code from any internet
14website maintained by the recorder or used by the recorder to
15display public records. The request must be made in writing and
16delivered by mail, facsimile, electronic transmission, or in

1person to the office of the recorder. The request must specify
2the personal information to be redacted and identify the
3document that contains the personal information.
4    Within 12 months after the effective date of this
5amendatory Act of the 95th General Assembly all county
6recorders that publicly display records on an Internet website
7must submit a written policy, including a timeline, to their
8respective county boards providing for the redaction of social
9security numbers from all records publicly displayed on the
10website. Any county recorder that launches a website on or
11after the effective date of this amendatory Act of the 95th
12General Assembly shall develop and implement a policy providing
13for the removal of all social security numbers from all records
14prior to the public display of those records on the website,
15and must file a copy of the policy with the county board of
16that county. Policies pertaining to the removal of social
17security numbers from records to be posted on the internet
18shall be made available to all employees of a county recorder.
19    No person or entity shall include an individual's social
20security number in a document that is prepared and presented
21for recording with a county recorder. This Section shall not
22apply to (i) State or federal tax liens, certified copies of
23death certificates, or other documents required by law to
24contain personal identifying information or (ii) documents
25that were executed by an individual prior to the effective date
26of this amendatory Act of the 95th General Assembly.

1    (b) The recorder shall redact the name and address of a
2peace officer from a deed or instrument under this Division
3upon the request of that peace officer. For the purposes of
4this Section, "peace officer" has the meaning provided in
5Section 2-13 of the Criminal Code of 2012.
6    Holders of a mortgage or lien on a deed or instrument that
7has had the name of a peace officer redacted shall be granted
8access, upon request, to the name and address of the peace
9officer on that deed or instrument.
10    (c) County recorders shall not be liable for any claims
11arising from unintentional or inadvertent violations of this
12Section.
