Amends the Public Utilities Act. Provides that an electric utility or gas utility that serves more than 100,000 customers on or after January 1, 2013 shall offer an Illinois Commerce Commission-approved, on-bill financing program to owners of multifamily mastermetered residential or mixed-use mastermetered buildings with 5 or more residential units no later than December 31, 2013. Provides that if a landlord increases the rent because of on-bill financing, then the tenant must be given 30 days' notice prior to the increase and the cause for the increase in rent. Provides that the obligation created by a loan issued under the program shall run with the meter. Provides that for each loan issued under the program, the electric utility or gas utility shall record in the county recorder's office of a county in which the property is located, a notice, with respect to the real property on which the premises served by the measures are located, of the existence of the loan obligation and stating (i) the total amount of the loan obligation, (ii) the term of the loan obligation, and (iii) that the loan obligation is being repaid through a charge on an electric or gas service provided to the property. Provides that within 60 days after the effective date, each electric utility or covered gas utility shall submit a proposed program to the Commission that fully comports with the provisions of the program. <SynopsisText>Replaces everything after the enacting clause. Reinserts the provisions of Senate Amendment No. 1 with changes. Provides that owners of such buildings may not use the program in such a way that repayment of the cost of energy efficiency measures is made on the tenant's utility bills. Removes language that provides that the obligation created by a loan issued under the program shall run with the meter. Removes language that provides that for each loan issued under the program, the electric utility or gas utility shall record in the county recorder's office of a county in which the property is located, a notice, with respect to the real property on which the premises served by the measures are located, of the existence of the loan obligation and stating certain terms regarding the loan obligation. <SynopsisText>Replaces everything after the enacting clause. Reinserts the provisions of Senate Amendment No. 1 with changes. Removes language that provides that the obligation created by a loan issued under the program shall run with the meter. Removes language that provides that for each loan issued under the program, the electric utility or gas utility shall record in the county recorder's office of a county in which the property is located, a notice, with respect to the real property on which the premises served by the measures are located, of the existence of the loan obligation and stating certain terms regarding the loan obligation. Provides that, beginning no later than December 31, 2013, an electric utility or gas utility shall also offer its program to eligible retail customers that own multifamily residential or mixed-used buildings with no more than 50 residential units, provided, however, that such customers must either be a residential customer or small commercial customer and may not use the program in such a way that repayment of the cost of energy efficiency measures is made through tenants' utility bills (instead of an electric utility serving more than 100,000 customers on or after January 1, 2013 shall offer a Commission-approved, on-bill financing program to owners of multifamily residential or mixed-use buildings with 5 or more residential units no later than December 31, 2013). Provides that an electric utility or gas utility may impose a per site loan limit not to exceed $100,000. Provides that within 120 days (instead of 60 days) after the effective date of the amendatory Act, each electric utility or covered gas utility shall submit an informational filing to the Commission that describes its plan for implementing the certain provisions on or before December 31, 2013. Makes other changes. Effective immediately.</SynopsisText><synopsistitle>House Committee Amendment No. 1</synopsistitle>
<SynopsisText>Replaces everything after the enacting clause. Reinserts the engrossed bill with the following changes. Provides that in the event the Illinois Commerce Commission approves changes to a utility's tariffs that reflects new or revised demand criteria for the utility's customer rate classifications, then the utility may file a petition with the Commission to revise the applicable definition of a small commercial customer to reflect the new or revised demand criteria. Provides that an electric utility or gas utility may impose a per site loan limit not to exceed $150,000 (rather than $100,000). Restores language that where an electric and gas utility retains an independent evaluator who shall evaluate the effects of the measures and the overall operation of the program including whether the payment obligation for permanent electric and gas energy efficiency measures that will continue to provide benefits of energy savings should attached to the meter location.
