Provides that a clinical laboratory or physician that provides anatomic pathology services for patients in this State shall present or cause to be presented a claim, bill, or demand for payment for these services only to specified people. Provides that the clinical laboratory or physician shall not charge, bill, or otherwise solicit payment for anatomic pathology services unless the services were rendered personally by the clinical laboratory or physician or under the clinical laboratory's or physician's direct supervision. Defines "anatomic pathology services". Makes other changes. Effective December 31, 2013.Senate Committee Amendment No. 2 Amends the Medical Practice Act of 1987 and the Illinois Clinical Laboratory and Blood Bank Act. Provides that a referring physician who takes a patient specimen may charge a patient or a payer an acquisition or processing charge when (i) the charge is limited to actual costs incurred for specimen collection and transportation, and (ii) the charge is separately coded or denoted as a service distinct from the performance of the anatomic pathology service, in conformance with the coding policies of the American Medical Association. Provides that a referring physician may send a patient's specimen to any laboratory providing anatomic pathology services. Provides that a person may not maintain an action to recover the actual amount paid for a bill made knowingly and willfully in violation of the Medical Practice Act of 1987 when the services charged for in the bill were provided at facilities licensed under the Hospital Licensing Act or the University of Illinois Hospital Act or clinical laboratories owned, operated by, or operated within facilities licensed under the Hospital Licensing Act or the University of Illinois Hospital Act, and the bill is for inpatient services or outpatient services from those facilities.Senate Floor Amendment No. 4 Deletes reference to:210 ILCS 25/7-105 new225 ILCS 60/70 newAdds reference to:410 ILCS 50/3.3 newReplaces everything after the enacting clause. Amends the Medical Patient Rights Act to set forth a prohibition on the markup of anatomic pathology services. Provides that a physician who orders, but who does not supervise or perform, an anatomic pathology service shall disclose in a bill for such service presented to the patient certain information and that such physician, when billing a patient, insurer, or third-party payer, shall not markup, or directly or indirectly increase, the amount subject to disclosure. Provides that the prohibition does not prohibit a referring physician from charging a specimen acquisition or processing charge under certain circumstances. Sets forth provisions concerning applicability, reimbursement, and violation. Requires the Department of Insurance to enforce the prohibition on the markup of anatomic pathology services for any bill submitted to a payer in violation of the prohibition. Defines "anatomic pathology services".Governor Amendatory Veto Message Recommends adding language providing that: nothing in the new provisions shall be construed to prohibit a referring physician from sending a patient's specimen to a laboratory providing anatomic pathology services; and the Department of Financial and Professional Regulation may revoke, suspend, or deny renewal of the license of a physician who undertakes a markup of a bill in violation of the new provisions. 2/13/2013SenateFiled with Secretary by Sen.
