<reference>320 ILCS 42/40 new</reference><aliasreference></aliasreference><SynopsisText>     Amends the Older Adult Services Act. Adds provisions creating a Home Care Consumer Bill of Rights, which includes the following rights: to basic safety; to information concerning the availability of home care services and other matters; to choice, participation, and self-determination in connection with planning home care services; to care and services provided in a way that promotes a consumer's dignity and individuality; and to redress of grievances. Requires the Department on Aging, in collaboration with the departments of Public Health and Healthcare and Family Services and other agencies, to develop a plan for enforcing the Home Care Consumer Bill of Rights. Effective immediately.</SynopsisText><synopsistitle>House Floor Amendment No. 2</synopsistitle>
<reftype>Adds reference to:</reftype><reference>20 ILCS 2405/17.1 new</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause. Reinserts the provisions of the bill as introduced, but with the following changes and additions: In the amendatory changes made to the Older Adult Services Act, (i) changes the definition of the term "Home care consumer" or "consumer" to mean a person "aged 60 or older or a person with disabilities aged 18 through 59" who receives services in his or her home or community to promote independence and reduce the necessity for residence in a long-term care facility (rather than a person who receives services in his or her home or community to promote independence and reduce the necessity for residence in a long-term care facility); (ii) requires the Department on Aging and the Department of Human Services (rather than the Department on Aging) to develop a plan for enforcing the Home Care Consumer Bill of Rights; (iii) provides that in developing the plan, the Departments (rather than the Department) shall establish and take into account best practices for enforcement of those rights, and the Departments (rather than the Department) shall make those best practices available to the public through their official web sites (rather than through its official web site); and (iv) provides that the plan shall include a description of how entities with a role in protecting older adults "aged 60 or older and persons with disabilities aged 18 through 59" (rather than in protecting older adults) will coordinate activities to enforce the Home Care Consumer Bill of Rights. Amends the Disabled Persons Rehabilitation Act. Adds provisions creating a Home Care Consumer Bill of Rights identical to the provisions creating a Home Care Consumer Bill of Rights under the Older Adult Services Act. Effective immediately.</SynopsisText></synopsis>
