Changes the definition of "new facility" to include an existing facility that expands or modifies its operations to increase the animal unit capacity. Provides that, within 10 calendar days after notification by the Illinois Department of Agriculture to the owner or operator that the registration and notice of intent to construct are complete, the owner or operator of the proposed facility shall mail by certified mail, return receipt requested, a copy of the complete notice of intent to construct form to the owners of property located within the setback areas. Makes changes to provisions concerning public hearings and final determinations. Provides that livestock management facilities or livestock waste handling facilities constructed after the effective date of this amendatory Act of the 98th General Assembly shall not have man-made conduits from surface waters to those livestock management facilities or livestock waste handling facilities. Provides that a livestock management facility's waste management plan shall be submitted to the Department and the Department shall make the plan available to the public. Adds information that a waste management plan must include. Provides for civil actions under specified provisions of the Act. Effective immediately.</SynopsisText></synopsis>
