Limits the authority of the Illinois Pollution Control Board to prescribe ambient air quality standards for criteria air pollutants, such as Nitrogen Dioxide, if those standards are more exacting than the National Ambient Air Quality Standards set by the Administrator of the United States Environmental Protection Agency. Effective immediately.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>
<reftype>Adds reference to:</reftype><reference>5 ILCS 100/1-5</reference><aliasreference>from Ch. 127, par. 1001-5</aliasreference><SynopsisText>Replaces everything after the enacting clause. Reinserts the provisions of the introduced bill with the following changes. Amends the Illinois Administrative Procedure Act. Exempts rulemakings of the Illinois Pollution Control Board that implement any type of ambient air quality standard from the requirements that ordinarily apply to general rulemakings, emergency rulemakings, and peremptory rulemakings under the Act. Further amends the Environmental Protection Act. Also exempts those rulemakings from the ordinarily applicable rulemaking requirements of Title VII of the Environmental Protection Act. Provides for the consolidation of rulemakings of this sort. States that the provisions of the introduced bill, as amended, shall not be construed to limit the right of a person to submit a proposal to the Board, or the authority of the Board to adopt, air quality standards that are more stringent than the standards promulgated by the Administrator; however, those more exacting proposals would, in order to comply with subdivision (a)(6) of Section 7.2 of the Act, have to be consistent with the federal regulations and adopted in accordance with all of the general rulemaking requirements of the Illinois Administrative Procedure Act and Title VII of the Environmental Protection Act.
