Provides that the definition of delinquent minor shall not apply to any minor who at the time of an offense was at least 15 years of age and who is charged with aggravated unlawful use of a weapon where a sentence of periodic imprisonment is prescribed for the offense. Amends the Criminal Code of 1961 relating to the offense of aggravated unlawful use of a weapon. Eliminates from certain first offense Class 4 felony violations of the statute that the offender must be a person 18 years of age or older. Effective immediately.House Committee Amendment No. 1 Provides that the definition of delinquent minor shall not apply to any minor who at the time of an offense was at least 15 years of age and who is charged with aggravated unlawful use of a weapon where a sentence of imprisonment (rather than periodic imprisonment) is prescribed for the offense.Judicial Note, House Committee Amendment No. 1 (Admin Office of the Illinois Courts) HB 2067 (H-AM 1) would neither increase nor decrease the number of judges needed in the State. Pension Note, House Committee Amendment No. 1 (Government Forecasting & Accountability) HB 2067 (H-AM 1) will not impact any public pension fund or retirement system in Illinois. Housing Affordability Impact Note, House Committee Amendment No. 1 (Housing Development Authority) This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence. State Debt Impact Note, House Committee Amendment No. 1 (Government Forecasting & Accountability) HB 2067 (H-AM 1) would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. Fiscal Note, House Committee Amendment No. 1 (Illinois State Police) There is no fiscal impact to the Illinois State Police. Land Conveyance Appraisal Note, House Committee Amendment No. 1 (Dept. of Transportation) No land conveyances are included in HB 2067 (H-AM 1) therefore, there are no appraisals to be filed. Balanced Budget Note, House Committee Amendment No. 1 (Office of Management and Budget) The fiscal impact of HB 2037 (H-AM 1) is minimal. It is anticipated that youth committed to the Department of Juvenile Justice (DJJ) as delinquents with indeterminate sentences will transfer to the Department of Corrections (DOC). These transfers would lower costs by moving youth to lower cost-per-year facilities at DOC. However this will likely be offset by youth sentenced to longer terms of incarceration at DOC facilities than they would be if detained by DJJ. State Mandates Fiscal Note, House Committee Amendment No. 1 (Dept. of Commerce & Economic Opportunity) HB 2067 (H-AM 1) does not create a State mandate.Home Rule Note, House Committee Amendment No. 1 (Dept. of Commerce & Economic Opportunity) HB 2067 (H-AM 1) does not pre-empt home rule authority.Correctional Note, House Committee Amendment No. 1 (Dept of Corrections) The corrections and fiscal impact on the Department of Corrections is minimal.
